Nelson, ended abruptly here to-day, when Justice Putnam directed the Jury to bring In a verrtict of 'not guilty," on the ground that no evidence sufficient to prove his guilt had been presented by the state. The defence had of fered no evidence, for after Ralph C Green, attorney for Schwartz, had rnded the cross-examination of an expert he made hi » motion, which was granted. The first witness the propecution put on the stand this morning was Dr. John Moore, of the State Hospital at Central Islip. who Identified pieces of lead and pun wa Ming found In Nelson's body at the au topsy. These were admitted only after a stiff right Dr. Moore said that Nelson had b"en shot twice In the back with charges of buckshot. Dr. George A. Ferguson, of I Stuyvesant avenue. Brooklyn, testi fied that the stains on the corduroy hunting coat and the overcoat were of human blood, and that he was reasonably sure that the stains on the shoe were of human blood, also. • Now. doctor, will you state positively that the stains on. the shoe were human blood?" was the first question by Mr. Green, who was coached by Dr John J. Suspicion fell on Schwartz It had been expected that the girl would be an impor tant witness, but a few weeks ago. while in Manhattan, her clothes caught fire and she was fatally burned. This left Mrs Nelson as the most impor tant tritneos, but in the trial she became practically a witness for the defence and contradicted much that she had repeated at the inquest.
