•A court martial is merely an agency of
the executive arm. and the members thereof
do not, because they act in a collective ca
pacity as a court, cease to owe respect and
?übordlr.atk>n to higher authority. In no
system of laws is It contemplated that in
ferior eoarta can disregard the decisions
and tostroctton« of their superiors. Other
wise it ■would be Impossible to have that
orderly and uniform administration desired
by all enlightened countries. The War De
partment has adopted certain policies in re
pard to deserters, and officers of the army.
when called upon in their official capacity
io act thereunder, should do so in a loyal
and subordinate spirit. This court took an

reviewing authority is now placed In the
