New low price records for the year were made by the larger number of ac tive stocks in the last hour of business in yesterday's operations, declines from the high figures of th*» morning running: from 2 to more than 4 points. In the early dealings covering: of shorts brought about moderate improvement in the general level of quotations, as compared with Saturday's final figures, but the movement was not accompanied by buy ing by important market interests, nor was there any response from the public as represented by commission houses, orders for outside account being con fined as a rule t» sales by people who evidently believed that under prevailing conditions cash Tvas preferable to stocks carried on borrowed money. The selling in the final trading was heavy enough to create uneasiness in minor speculative circles, and the fact that investment stock came out naturally encouraged heavy pressure from the professional bear element, which has made enormous profits in the markets of recent days. St. Paul was the leader of the afternoon break, declining from 126 to 121 in a few minutes without attracting support from inside sources. Lack of support from in terests identified with the various rail road companies has been one of the most discouraging market features ever since the government announced its intention to prof against the Western railroads that combined to advance freight rates. Doubtless the fact that up to the close of business on the Stock Exchange no decisive news came from "Washington regarding the efforts of the railroad presidents to compel the administration to accept their view of the railway rate situation -was the chief factor in turning the market from a position of moderate strength to one of intense weakness, as then was nothing in the day's develop ments affecting the actual worth of in vestment securities that warranted liqui dation. Favorable advices were received from the Western farm*, but professional pessimists continued to talk industrial panic. Efforts to undermine confidence in business circles are being relentlessly pushed by speculative man buzzards, un wittingly encouraged by the imprudent remarks of quick tempered railroad men, who because of the railway freight ad vance injunction proceedings have rushed to the foolish conclusion that the trans portation companies are not. to be per mitted to do business at a profit. It is absurd to believe that the railroad?, which probably have been the greatest factor in the industrial development of th* United States, which employ millions of men and upon which so many of our ;-.< nrio depend for their income from their vested fund, are to become losing proposition* because the government de sires to find out whether or not they have combined to do something which 1? contrary to law. Final prices in yester day's stock market were well above the lowest, owing 10 a resumption of buying by the shorts In the last few minute* of trading. One of the important declines in yes terday's stock market was supplied by American Sugar Refining issues, which suffered a maximum loss of more than 4 point*. Selling of the stocl: came en tirely from professional interests who believed that reports from Washington of government proceeding* against the company, on the argument that the con cern ■ operating In restraint of trade, would bring act investment holdings. Commission houses, however, reported no sale* for the account of important in terest*. If ouch a suit should bo brought the company, or trust, as It is popularly l.'.nwr, doubtless in 8 way would wel come the action, as the result of the litigation would determine for all tim« the standing- of the corporation under th*» Sherman law. The heat friends of the American Sugar Refining Company will admit that in the past it has transgressed the federal laws; but its worst enemies cannot prove that under normal trade conditions and with all due regard for NEW-YORK DULY TRTRTXT TTESDAY. .TINE 7. 1910. the law it cannot show a large surplus above dividend requirements. Th'^ only wonder is why in the past any attempt srtotild have been made by the company to increase earnings by violating- the law. Interests closely identified with the com pany assert th^t Its assets at the pres ent time, if liquidated, would return to the stockholders a sum of money far In txcess of the current market value of the capital stock. In the nineteen years of its corporate existence, the American Sugar Refining Company has paid 7 per cent annually on its preferred stock and a total of more than I>«2 per cent on its common. Dividends have not been paid at the ex pense of working capital, nor have dis bursements been made which have Inter fered with replacement work. If the American Sugar Rclining Company should dissolve t^-day actual buyers of the atock at yesterday's lowest quotation would find a proiit in their operation. It is interesting to not* that the company continues to refine sugar at a profit. In spit~ of the talk of Wall Street bear-? that it will be driven into bankruptcy. And the same thing applies to the Amer ican Tobacco Company, against which a suit under the Sherman anti-trust law is now pending in the Supreme Court.
