Oct. 17.— The abandonment of op position to a suit brought by the Attorney General of New Hampshire to restrain the j Boston & Maine RaHroad from continuing in effect certain freight rates on leased lines alleged to be in violation of the stat utes was announced to-day by President Charles B. President Mellen states that the railroad intends to obey the statutes literally and will restore th« old schedule in cases where it is found that rates have been raised! ille gall3-. COURT CIIriTgIVES UP JOB Action for Removal of Wilson Undecided When He Resigns. Heman R. Wilson, clerk of the 7th Dis trict Municipal Court. No. 73 Manhattan avenue, handed In his resignation yester day, to take effect at once. On February 3 Raymond B. Fosdiek, Commissioner of Ac ccuntst made an examination of Wilson accounts, and he reported to the Mayor that there was at that time an apparent discrepancy between the amount of the trust funds that should have been in tho bank and the amount of money actually to the credit of the account. The report o° Commissioner Fosdiek was sent to the District Attorney, but th© grand jr.ry failed to take any action. Then a pro ceeding was begun for the removal of Mr. Wilson by the Appellate Division. The case was sent to ex-Justice Gllfler- Sleere, as referee. Wilson's resignation was handed in to him yesterday.
