Whitman .mnounced dehnitely yesterday that he was working tc
thil end. and expected tlic case to come up in April or Mav
Beckrr left Sing Sing in custody of Under Sheriff Frank K.
Bowers, accompanied by his counsel and his wife. her face bnght
ened by happy smiles. She declared it was the happiest day in her
life. A touch of triumph was given to his depaiture by the dicers
which the convicta sent after him as he passcd the cell block on his
wav to the station.
GUNMEN TO DIE WEEK OF APRIL 13.
Back in their cells in the death house the four gunmen whom
Becker was convicted of inducing to kill Rosenthal rcmained ..ulk
ing and v.eakening in their dctomination not to turn against hin*.
and tell all they know diid snariing at the shouts of triumph that
marked his departure.
The gunmen are doomed to die for the murder during the week
(beginning April 13. the date fixed yesterday when the judges of
; the Court of Appeals signed their death warrants.
It was expected that Becker would be brought to this city
through the Grand Central Terminal. and a crowd of scveral hun
dred WtYt waiting there to scc him. They were disappomtcil. how
I ever. By order of Sheriff Grifenhagcn Becker's custodians took him
jofl the train at 12.Sth street and hurried him into an automobile. fai
which he was rushed down Fifth avenue to Washington Square
land then to the Tombs. Those in the car with him said hc took
I a kcen delighi m seeing the lights of the town once more.
WHITMAN WONT DISCUSS NEW EVIDENCE
In his announcemenl that hc was prcparing to bring Becker
| Up for a second trial District Attorney Whitman refused yesterday
to say whether he had new evidence to prewnt, but added that
under the rulings ol another judge testimony might be drawn from
witnesses who appeared in the hrst trial which they were not per
mitted to give nl ihat time.
As tO the question whether ?'SatrT Schepps was an accomph. -
10| not hc said that would depeud entirely upon the nilings in the
new trial, regardless of what ihe Court of Appeals had to *av
| ahout it.
Charles G. F. Wahle. counsel for the four gunmen. said that he
had not given up hope for his clients. and was working on plans
? which he thought would free them, bul he refused to indicate whnt
! these plans were.
A number of the jurors who found Becker guilty cxpics>ed
indifferencc yesterday to the action of the Court of Appeals tn sct
(ting asidc thrit verdict. but Harold B. Skinner, the forcmau. agreeil
heartily with Judge Wcrner, who opposed the reversal. Mi Skinnei
said the jury had the ojiportunity of seeing the witnesses them
| selves and forming a judgment as to their testimony.
Thinking that Becker would be brought into New York bv wav
Of the Grand Central Terminal. a lieutenant of the East 51st Itreei
station Iaid plans for a rousing wekome. He rang up the Sherilfs
office and proposed that he send one hundred policemen to the Grand
Central. ostensibly to presetve order and keep back the crowds?
incidcntally. perhaps, to shout for their former comrade.
Sheriff Grifenhagen. however, vetocd the plan. as he had worked
out a way of his own to avoid anything like the spectacular days of
Juluis Harburggr by having Becker taken off of the train at 125th
street. and removed to the Tombs in an automobile. So the grand
welcome from the "system" fell through.
