Brooklyn taxpayers will apply to the
Supreme Court to-day for an order to
compel Mayor Hylan and other city
officials to show cause why they should ;
not be prevented from fulfilling a con- j
tract to pay the New York Utilization.
Company $1,000 a day to reopen the
Barren Island garbage disposal plant. !
R Percy Chittenden, a Brooklyn,
lawyer, said last night, that he would
appear as counsel for several Brooklyn
civic organiaztions that are waging the ,
light against the resumption of the re-1
duction work on Barren Island.
"We are bringing this action, said |
Mr. Chittenden, "because Commis- ?
Kioner MacStay of the Department of
Street Cleaning made this contract
without advertising for bids, as the
law provides. Copies of the order will :
bo served on Mayor Hylan, on Con-,
troller Cralg, to prevent him paying:
any public money on this contract, and
on Commissioner MacStay to prevent j
him from having garbage delivered to,
the Barren Island plant."
Mr.' Chittenden said that garbage!
was delivered to Barren Island on Sat- ;
urday for the purposes of making tests
preliminary to opening the plant to
capacity. He said his injunction would
force the city to send its garbage to
Staten Island and reopen the plant
there.
Commissioner MacStay was wrought
up yesterday because of the eiTorts to
prevent the reopening of the Barren
Island plant.
"I made the contract in accordance
with a prorogative given the Street
Cleaning Commissioner under the chat
tor," he said. "The contract with the
New York Utilization Company run?*

mediately if I obtain satisfactory bids
from other contractors and I adver?
tised to-day. Bids are to be opened
next Friday."
A three and possibly a five year con?
tract is about to be awarded to the
Brooklyn Ash Removal Company by the
Ilylan administration for the removal
of ashes in Brooklyn, Manhattan and
The Bronx.
It is estimated that the bid which
the city officials are planning to ac?
cept proposes an increased cost of
51,000.000 a year over tho existing
contract. The official who has this
matter in charge is Commissioner
MacStay. Mr. MacStay said yesterday
that his advertisement for bids for
this contract had brought but Iwo re
sponses, one from the Brooklyn Ash
Removal Company and the other from
"George Plynn."
The Brooklyn A ?-li Removal Com?
pany has had a contract with the city
for this work for the last fivo years,
and this agreement lapses next month.
This concern's old contract called for
?'.':! cents per unit (one and a half
cubic yards', but in their new bid they
ask $1.40 per unit. The "Flynn" bid
quoted $1.75 for the removal of each
unit.
President W. F. Donovan of the com?
pany said he was under the impression
that the mysterious "Mr. Flynn" who
v,na his rival bidder was George 11.
) linn, of Plinn & Booth, 17 Battery
Place. Mr. Donovan said this was the
largest concern in the world engaged
in the business of disposing of the
iish accumulation of municipalitie .
