T. Crain. He had spent eight ' ?aonths in the Sing Sing death house j ?hen Judge Crain granted him a new J ?rial, basin2 tll?3 action on n("w' evi" ;e?ce obtained by Robert M. Moore, fianagan's lawyer. Flanagan was taken to the Tombs 'ollowing his acquital and held on an? ther indictment charging him with robbery in the first degree. H? was arrested following the hold 3p and robbery of an Armenian restau? rant on Washington Street. This was tome time, after the hold-up in Rooney's saloon and the murder of Mulhearn. Vincent Lopez, who was present in Rooney's saloon when Mulhearn was shot, Identified Flanagan as one of the tiro men who had fired the shots in ithe laloon. Lopez also identified a man named Alexander Johnson as hav? ing been present, but the latter was ac qaited of the murder charge by Judge Charles G. Nott in General Sessions , nearly a year ago. Lopez Repeats Accusation During the second trial of Flanagan, I Lopez again testified that Flanagan : ?as one of the two men who fired the chota that killed Mulhearn. Eight other witnesses who were in the saloon at the time testified that ; Flanagan was not the man. They de- | Kribed the murderer as being five feet, :'our inches in height. Flanagan ie i ;ve feet, ten and a half inches. They also testified that the hold-up men ?poke broken English. When all the evidence was in Judge ; Rosalsky directed the jury to acquit '. ?nd when this was done the former : turned to Flanagan and said: "I want you to understand, Flanagan, : hat your verdict is not a personal victory. It is a case where justice aust prevail. I do not know whether jou are guilty of this murder or not. There was a reasonable doubt and the court has given you the benefit of that ooubt.
