Louis Levy, of the I iw firm o ' Stanch field * Levy, who has succeeded Colo- J? nei William Hayward as counsel for Wendell, objected to this question and was sustained h> Justice Kenn?'':?. who ruled that Mr. Pe<;ora had failed to connect the Deputy Comptroller with the crime alleged to have been com? mitted m connection with tho state bond purchases. Wendell Threatened With Contempt Earlier in the day Mr. Wendell had boen threatened with punishment for contempt ?\s a result of his refusal to answer questions pertaining to several letters dealing with the so-eall?! "moral obligation sale" of November 16, 1917, which appear to be missing from the Comptroller's correspondence files. This deal involved the purchase by the Comptroller's office through Fanshawe & Judson of bonds to the par value of $2,013,000 at a price six or seven point's in advance of that quoted in the open market. It has been shown that this transaction resulted .n a loss to the state of more, than $100,000. After much wraiigling*between Mr. i Levy and Mr. P?cora the court de? clared that if .Mr. Wendell refused to an? .ver ?ii? - questions re!,.tin?.; to thi missing letters he would be adjudged in c? ;.tempt and punished nccordii gly. When Mr. Wendell finally consented ..... his memol'y \va hazy as t ? the missing correspondence. He said he could not recall ever having seen or written any of the letters referred to by William S. Fanshawe in his testi? mony one week ago. He would not swear, however, that he had not re- ! ceived or written the letters. He ex? plained that lie signed between "00 ' and .r" 0 letters every day. and that it was impossible for him to recall the specific ones which the broker had de? clared were surrendered to Mr. Travis as one of thi c nditions under which the latter agreed to the "moral obliga? tion," purcha ?, Several Letters Mislaid The witness said that the Comp? troller's fib -. had b<. n gone over many times in the last six months and that as a result several letters have been mislaid. In the afternoon, there was a pro- I longejd argument as to th.- part Mr. TravTs had played in the various bond purcl as? ? and the extent of h s ; . sj onaibility for tl ? m.
