Tho Mayor refused to sign the resolution and sug gested an amendment whereby the company purchasing the two extensions might have at a nominal rent a perpetual use of the Third Ave nue Company's tracks In 125th street and Man hattan street connecting the two extensions (to the north and to the Bouthl. The Metropolitan Com pany had filed a nominal protest against tho i sale and began two suits, ono in Its own behalf and one In behalf of a taxpayer named O'Conf nor. asking thnt the Comptroller bo enjoined from selling tho franchises. At the sale tho Metropolitan Company, through the medium of a newly organized company, forced up the bid ding until the franchise for the two extensions was cold to tho Third Avenuo Company on an offer to give to the city 38-a per cent, of the i gross receipts, in addition to the upset price of S per cent, for tho first Ave years, and 5 per cent, thereafter; plus, also, tho bonus of $250,000. The franchise was awarded to the Third Avenue Company, and the Comptroller required It to give a bond of 1,000,000 to securo the per formance of the contract and the payment of the $250 000 cash bonus. The Third Avenue Company went to work, contracting for material. It claims, to the extent of 1. 000,000, and excavated a mile and a half for the laying of rails, when last December tho O Connor suit was brought up again and a mo tion for a preliminary injunction was mado be fore and denied by Justice Truax. Then camo the suits of Mrs. licekman and Mrs. Christ. Tho former owns property nt 182d street and the KIngsbridge road, and the latter Is her tenant. A permanent injunction was asked for, tho lead tag objections to the legality of the consent to the granting of tb franchise given by the city under the .State Itallroad act being, first, that more than one extension of lines nlready exist ing was Included In the resolution and notice of sale and that the city bad no power nnder tho statute to cll moro than ono at one bid; and second, that the city exceeded the power given toitlntho matter of disposing or franchises nnder the State rallroid law (known as the Can tor act) in demanding a cash bonus In addition to the proportion of the grots receipts of tho road ottered by the purchaser. The caso was carried Immediately lo the Appellate Division, which lent tho case to tho Court of appeals, with the result mnile known yesterday.
