On Wednesday afternoon Joseph Frankau of tho Hotel Mctropole and a clerk from II r. Iless's office called at the court and asked the Magis trate to Issue a warrant for Cuthbert's arrest. Irsnkau said Cuthbert had got from him OTer $3,000 through bucket-shop transactions, out It wns not on that account he wnnted Cuth bert arrested. Cuthbert, he said, had violated section 363 of the Penal Code, which provides against the use of tho words "and company" In a arm name unless there is an actual partner for whom the words stand. Frankau declared that Cuthbert bad no partner, and consequently broke the law. Magistrate Wentworth refused to issue the wtrrant, but did Issue a summons for Cuthbert's s;ptaranre in court yesterday. Proceeding negun to necover Lands la tho Sarnnac Region Valued at 1,000,000. Albany, Sept. 2. Proceedings have been begun through the Stato Comptroller's office by the Flsberlos, Game, and Forest Commission to recover for tho Stato some valuable Adirondack lands title to which has been lost through tho cancellation by former Stato Comptrollers of tax sales on which the Stato's title to the lands was based. The fact that such proceedings were about to be begun waa reported some months ago. and ever since the cases have been In active preparation. Within a day or two Comptroller Roberts has fixed upon Sept. 23 and 20 as the dates when ho will give hcurlngs In three cases involving title to lands in Township 23. Frank lin county; In Arthurboro patent, Hamilton county, and Township 20, Franklin county. Townships 20 and 23 comprise lands valued at probably a million of dollars. Township 23 being the Sarnnac region, and embracing many of the most beautiful lakes In the Adlrondacks. Tho Stato will endeavor to reclaim these val uable lands under a section of the Malby bill passod by the last Legislature, providing that the Comptroller is authorized and empowered and shall, upon the application of any one ag grieved thereby, set aside any cancellation of a tax sale made by him or by any of his predeces sors in office. Incases "when such cancellation was made upon application, which thn Comp troller or any of his predecessors in ofllce bad no jurisdiction or legal right to entertain at the time of such cancellation." The flrst step in each case begun under this law is undertaken, as in the present Instance, by tbo State Fisheries, Game and Forest Com mission, which makes application to the Comp troller that he set aside the cancellations made of the tax sales and reclaim the lands for the Staf. Hearing on the Propoaal to Coastrnct a New Road Through tho Adlrondacks. Albany, Sept. 2. The State Railroad Com mission to-day gave a hearing in tbo matter of tho application of tho New York and Ottawa Railroad Company for s certificate of authority, under section 59 of the State Railroad law, to construct a line of railroad from Molra, Frank lin county, to a point on the St. Lawrence River. It has been said that the road is a part of a scheme to extend the Delaware and Hudson sys tem from the present terminus of the Adiron dack road, which it controls, at North Creek, Warren county, to tbe St, Lawrence River. If this wero consummated it would shorten the distance between New ork and Cnnsda by flfty-snven miles. The officials of tbe Delaware and Hudson deny that their road Is In any wise connected with this new road, but say that they are not unfavorable to It. Tbe New York Central and Hudson River Railroad and its branch lines, the Mohawk and Malono and the Adirondack and St. Lawrence, oppose the application, nnd this opposition was formally laid before the State Railroad Commission at Its session to-day. The now road was represented by It, B Moffatt. C. B. Hibbard. and Henry Sanger Know. The railroads comprising the Central Hudson system were represented by the Hon. West Brighton, Staten Island, owned and for merly occupied by the Barrett, Nephews & Co. dyeing and cleansing concern, wero destroyed by Are early yesterday morning. Tho fire la be lieved to have been of Incendiary origin. The factory consisted of a two-story brick structure and three one-story brick buildings, and were occupied by the De Metz Manufacturing Com pany, makers of bicycle tubing and umbrella frames. Tho tiro was discovered by a watchman about 1:30 o'clock. It appeared to have started in each building at the same time. There was nearly half an hour's delay In giving the alarm, and when tho tire companies arrived the Interi ors of all tbo buildings were ablaze. Thcrenrea number of frame dwellings near the factory and u. general alarm waa turned in, calling out seventeen of tbo volunteer lire com panies In tbo North Snore Department. They prevented tbe spread of the flames. Three members of Washington Engine Company were at tbe top of a ladder resting against tha brick wall of one of tbo burning build ings when the wall fell. They Jumped clear of the wall, whlib tumbled Into tho burn ing structure, carrying the ladder with it. The loss on tbe buildings is about $30,000 and Is covered by Insurance. The total number of visiting merchants registered up to last night was nearly 2,500. Tho orflcers of tho association are still work ing hard to open up additional territory through the railroads nnd steamship companies, and to obtain for their non-resident members additional facilities to enable them to reach New York. Yosterday the Southern Paclflo Company gave notlco that it would place on sale tickots from all points in Texas reached by their roads through to Washington, Richmond, and Norfolk, between the dates Sept. 10 to 1 1, inclusive, provided their connecting roads in tho South would consent to bandlinir their tickets and hauling their passengers through to those points on those dates. This concession was In response to n requost made by tho Mer chants' Association asking for thoso dates In addition to th dates of Sept. 1 to 4, inclusive, on which the Southern Pacific hnd already an nounced that it would sell reduced rato tickets through to Washington. The Trenton Com mon Council held a special meeting to-night and voted to offer a reward of $100 for tbe arrest and conviction of Peter W. Crozer. who is wanted for embezzling the funds of tbe two wrecked loan associations.
