Another test is to be made of the constitution ality of the law relating to ticket scalpers, chapter 306 of the Laws of 1397. which went Into effect on Sept. 1. and to this end Louis 1L Relnach, a travelling salesman, boucht yester day from George Tyroler, a ticket broker of 423 Broadway, a passage ticket to Norfolk. Vs.. over the Pennsylvania Railroad. He then had Mr. Tyroler summoned to Jefferson Market Court, where a formal complaint prepared by the defendant's counsel, T. J. McManus, and As sistant District Attorney Mllllken was ready. On this complaint Tyroler was arraigned. Mr. McManus told Magistrate Cornell that the action had been brought after consultation with the District Attorney ln order to teat the constitutionality of the law. He asked that the defendant be paroled ln his custody until Mon day, when an apollcatlon far a writ of habeas corpus will be made to a Justice of the Supreme Court, and the matter carried to the highest tribunal. Magistrate Cornell read a copy of the law shown to him by counsel, and said that, ln his opinion. It was a most reckless piece of legis lation, and that he would be oiad to aid any test to be made of its legality. Mr. Tyroler was paroled ln the custody of his counsel, as re quested. The Commercial Travellers National League has also taken up arms against the Scalpers law. It is sending broadcast copies ot the law, to which la attached the following notice: "If you are opposed to this iniquitous law, send your name and address, and a list of the Ftate legl-lators voting for and against this measure will be mailed to you." Instead of going up that avenue the car went to Broadway and Fifty-ninth street and then went downtown. The men of princi ple were toldto trnasfer to a Columbus avenue car at Fiftieth street, but Insisted upon having one continuous passage and remained ln the car during three trips until the car Anally turned up their avenue. They Insisted upon riding for one fare, and were arrested when they refused to pay a second time. When the cane was explained to Magistrate Mott he said the men had acted like children. "This Is a very trivial principle to create so much fuss about, he said. "It apnears to me that the passengers were not iusuiled In mak ing the demands of the cable road which they did make. When a person enters a puhua conveyance tney are oouna to sunmit to tne rules governing the operation ot that convey ance. "In this case the comDany had a car ln readi ness at a certain street to take those passengers from the Broadway car who wished to go up Columbus avenue. It was a trivial matter to the passengers whether they went in the car they were in at the time or transferred to an other car, but it was, perhaps, of considerable Importance to the company In carrying out the usual schedule." Mr. Baker said that when the men of prin ciple boarded the car it had the sign "Colum bus avenue" on it and ca-ried a blue light. In dicating U.at it was going up that avenue. These signs were not changed until the Dolnt of transfer was reached. "Suppose I should buy a ticket for one con tinuous trip to California." aaid the Magis trate, "and when we reached Chicago the com pany wanted e to get Into another train for my destinatlo do you think I could legally Insist upon being carried to my destination by the train I boarded at New York! Of course not; but that is a good Illustration." There was some doubt as to whether the Magistrate could send th case to Special Ses sions, but Mr. Baker wanted it to go to a higher court, so Magistrate Mott adjourned It until next Tuesday to look into the matter. There was an explosion, and the painter went flying headlong from his ladder. The blazing varnish was scattered over the stairs, and they caught Are at once. There were forty tenants ln the building, who found their way out cut off.
