for tho railroad company asked that tho
suit bo set for trial next Monday, and
Holmes objected on tho Kinund that ha
needs more time to cx.imliiu the olllcers.
Holmes allcsed that thero Is Brave
doubt as to whether such a surplus exists
as Is claimed because of questionable
Items credited to thu profit and loss ac
count slnco 1SS7. He says that more than
$58,000,000 was credited to this account
at ono time as profit from stock specula
tion In the Noithern- Hecurltles transac
tion, but the correctness of this Item de
pends on the amounts realized from rein
vestment In stocks. Some of these stocks
nre not listed. Holmes says, but from
what he has learned of the value of those
that are listed he believes there Is a de
preciation of nearly 14 5.000,000 which
must ho charged against this fund.
Holmes nlso objects to an Item of
11.000,000 ptoflt through the merger of
Western corporations Ir.to the Oregon and
Washington Hallroud and Navigation
Company and says the propriety of this
entry Is much In doubt ar.d can be deter
mined only through an examination of the
ofTlcers. The same criticism applies to
416,000,000 claimed to havo been made by
the exchange of convertible bonds of tho
defendant and Its auxiliary companies for
Union Paclllo common stock, he sajs.
