The complaint quotes liberally from th. contract between the Interborough arid the city. One of the part of the contract Included In the complaint ! Article 26. which provide that "no pay ment, credit, compensation or concession whatsoever shall be determined to bu part of the costs of construction or equip ment" unless the Interborough Mies with the l'ubllc Service Commission a dupli cate voucher or credit slip for It. Only aHHT, 105 Involved. tn Chief Knglnecr Craven's approval of the "prior determination" account re ferred to In the complaint, he stated that the Interborough submitted a list of vouchers for engineering and superin tendence," o. totalling $129,405.01, which was distributed over cost of con struction among several lines, and alo submitted "evidence of legal expense and administrative charges which, aftir eliminating the expenses of publicity campaign, aggregated I19M0O, also dis tributed under cost of construction." The total of these two amounts, (327,405.01, was mentioned by the Interborough yes terday as the only "prior determination" allowances Included under the dual con tract and affected by the city's equity suit. Corporation Counsel Hardy said last night that the suit should rtach trial In the Supreme Court In May, the city having preference on the court t-alen-dar. Mr. Hardy emphasized the fact that the city was never in a position to Me objections to the "prior determina tion" allowances because of the lack of vouchers and the concealment of the Items allowed and disallowed. Originally the Interborough put In a claim for more thin $l,D00,0(it for precontract expense, but this was cut down by Mr. Craen to $5s9.00O, In which amount, the Thompson committee and the city contend, were the Shouts, lingers and Oaynor bonuses. There were other developments es lerday growing out of the Thompson committee's activities besides the city's equity suit. CONFIRMATION DELAYED Senate to I'm on .Nominees "With out Itseommenilalkin," Al.r.ANv, March 14. Indication to night tire, that the nominations of Travis II, Whitney and Charles S. Hervey as membeis of the New- York City Public Service Commission and of the five State induiitrlal Commissioners will be con tinned by the Slate Senate, The Senate Finance Committee, not desiring to affront iSov. Whitman by de clining to report his nominations, while refuslrg to rejort any of the nomina tions to the Senate with a recommenda tion that they be confirmed, did by a close vote decide to reHirt the nomina tions "without recommendation." Thus the Finance Committee declined to take a position on the nominations, leaving It to the whole Senate to deter mine whether or not the nominations ahould be approved. Ordinarily these nominations would he reported to the Senate to-morrow and the Senate would act on them at once, but It was saul to night that the Finance Committee would not submit a report until Thursday, Usually there is a slim attendance on Thursday, und If this Is the case this week the action of the Senate may be poMponed until Monday night or Tues day. The doctor remarked that he did not agree with all Mr. Osborne's views on prison reform, atid Mr. Battle asked if he felt' friendly toward the warden. "I was always friendly until he refused to testify before me," said Dr. Dled llng. "Our relations are friendly now." Then .Mr. Hattle made him admit that before the (Jrand Jury that Indicted Mr. Osborne he had test! tied that he was not friendly to Mr. Osborne,- and finally Dr. Dledllng said It "made a slight dif ference' In their acquaintance."
