The people ?f the State of New York, represented in Senate and Asaem Mj, do eaact m follow*:? section 1. The legislative powera of the Corporatirm of the ettj ef New York shall be vested in a board of aldurmen and a board of coancilmtn who, together, ihall form the Con. bvd Council of the city. The Board of Aldeiinen aball consist of en? Aldermaa (rem each ward, who shall be elected by the people of the re Biive warda, for two years, The board of Connellmen 1 eonaiat of sixty members, to be elected from an many districts, who shall bo sworn into office on the first Monday in January next succeeding their election, and shall hold I heir offices for one year, and shall receive the tame compen sation at the Aldermen. See. I The membera of the Board of Aldermen first elected ?nder this act ahall be elasaifled as follow*:?On or before the first Tuesday in Daecmber aucecoiling the next general ?lection, the clerk of the city and county of New York shall, in the presence of the Mayor, Rcoordcr, and Comptroller, or a majority thereof, draw from a bo*, to be provided for the parnoee, in which two ballots shall have been deposited, hav ing ihereon respectively, either the word 'odd" or the word "even," one ballot, if the ballot ao drawn aball have thereon the word "odd," then the term of office of the Aldermen chosen from warda having an odd numerical designation, ahall expire on the first Monday of January, one thousand ?ight hundred and fifty hve. and in ease the ballot having Hereon the word "even'' shall >.e drawn, then the term or office of the Alderman having an even nnmerical designa tion ahall expife on the lint Monday of January, one thou sand tight hundred and tiftv aix. At all aobsequent elec tiuaa, Aldermen ahall bo elected for the full term of two years. See. 3. For the election of Councilman, the said city shall be divided into sixty illetrlots of contiguous territory, and a* near as may be or equal population, each of which shall chose one Councilman. The < ommon Council shall so di vide the eity into auoh districts on or before the first Monday iu September next, and thereafter within use year after the State and national census ahall have been compiled, the Common Council shall ill like manner re-district said city. Sec. i. Every act, resolution or ordinance appropriating mosey or involving the expenditure of money not, rendered imperative under pruvixiuus of any State law, shall origi nate in the Board of Connellmen, but tho Board of Alder men may propose or concur with amendments, aa in other eaaoa. See. 5. A vote ef two thirds of all the members elected to each Board shall he nressary to pass any act, ordinance or reaolntion of the Common Council which shall ha re been re turned by the Mayor with hia objections. See. C. No Alderman shall hereafter set or aet as Judge in the Court of Oyer aad Terminer, or iu the Courts of Uenrr.tl or Special Sessions, in the city and ootintv of New York; hut thia scction shall not prevent hia exercising the power of a magistrate on thearreat, commitment. orbailing of oilenders, exeept that he cannot let to bail or discharge a pe.'son ar rested or committed by another magistrate. See. 7. All ferries, docks, piers and slips, ahall be leased, and all leaies and salea of public property ami franchises, (other than grants of land uuder water, to which the owner of the upland shall have a pre-emption right,) shall be made by public auction, and to the highest bidder who will give adequate security, (no lease hereafter given, eicopt as the lame may he required by covenant of the corporation already exiaiing, shall be for a longer period than ten yearsj and all ferry leaaea shall be revocable by tho (.'ommon Council for miruianageu>ent, or ntplect to pro> ide adequate accommoda tion. All persona requiring any ferry lease or franchise un der the provisions of this act, shall bo required to purchase, at a fair appraised valuation, the boats, buildings, and other property of the former leasees actually necessary for the pnrpesea of sueh Terry. Previous notice of all sales referred to in thin seetion shall be given, uuder the direction of tho Comptroller, for thirty days in the newspapers employed by the corporation. Sec K. No bids shall be accepted from, or contract award ed. to any person who i* in arrears to the corporation up< u deit or contract, or who is a defaulter, as security or other wise, upon any obligation to the corporation. No money shall be expended by the corporation lor any celebration, procession, or entertainment of any kind, or on any occasion, except for the eeleliratlun of the anniversary of the national independence, the 2.">th of No vember.
