It wu alleged, on a search of his hougo, that he purloined pieces of muslin and poplin from the store of his employ ere; but the two pieces found, worth $'*'0. were not sufficiently identified by the clerks, and the jury acquitted the accused. Judge Russell said, that on that verdict he wan entitled to the property which had been taken from him and deposited with) the property clerk, and granted an order to that effect. Doyle left the Court in company Willi his wife, who appeared ;to be a very respectable woman. Some time since Doyle was tried and acquitted of burglary, L. O. Mr. Sedgwick, the As n-tiitit District Attorney, informed the Court that he would take a plea of guilty of burglary in the j i ccond degree, and at the same time handed the papers w> Judge Russell, who examined them. Heironymus Herold, residing at 19*1 avenue A, deposed that on the 6th of July his store and dwelling house wa* forcibly and feloniously broken open and entered by some person", and a quantity of leather, worth $R, was stolen herefrom that he has good cause to suspect James Beg lan; for c.n the above night his wife awoke him and told him thai some person was in the store; deponent got up and took hit revolver and went down stairs and beard j feme person in the store; deponent hallooed "Who Is here?" whereupon a person rushed out of the stnro into he eutry and ran out through Ibu lull door: another one I then caiiie to the door, when deponent fired his pistol at ' him. when he fell back and went to the front door of the store and unbarred it; deponent went to the entry door j and stood there, and when he came out deponent shot at him again ; he ran and deponent followed him around the corner in Fourteenth street, when Beg Ian turnel round and shot at him ; deponent then went back to his store, and on examining it found a quantity of blond on the glass of tho front door, together withjtw'o pieces of bone; one appear ing to be a piece of a jaw bone and the other apart of a tooth ; deponent was informed by Dr. Powell, two days after, tlmi he had dressed a wound for a man by the name of James IJeglan, who had been shot in the jaw and mouth, and that be had taken several pieces of boue from his jaw and mouth. Dr. l'owell, of No. 154 Second avenue, deposed that ho was a physician and resides at the above number, and that on or about the 6th of July last he was called to go U> F.ighth street, near the First avenue, between 4 and 5 o'clock in the morning; that on arriving at the place he found Dr. Alexander B. Mott there before him, who was examining a man who had been wounded in the right jaw; the wound appeared to bo a gunshot wound; the ball had entered between the chin and the teeth; three of the teeth had been destroyed; deponent did not attend to him, as Dr. Mott had arrived lirst. James Beglan, on being examined according to law, said that he was born in the city of New York, was un married, twenty years old, lived in First avenue, and was a gas fitter by trade I when the City Judge had finished reading the deposi I tions he remarked, in sentencing the prisoner, that the | papers exhibited a very clear cast of guilt against him, | and had he been tried on that charge and convicted, he ! could have been sent to the State prison for the term of | liis natural life. His Honor said he was informed 1 that the Grand Jury had found an indictment ! for an assault with intent to kill against Beg !
