Tbe plaintiff further alleges that the said contract waa a (r*u tulent one; that the taid Fernando Wood ia or waa in sons ? way, either directly or indirectly, interested therein. Trial he and the said Benjamin either knew or had reason t > know and believe when the said contract was made ttiut the said boxett, equal in every rqapect, could have b-jeu pro cured to be made for about one third of the price ti tmed therefor ? Jollie had no patent therefor, and wasnot en titled to any ; and that the said iurention was not patenta ble by the said Jollie; that the sad Fernando Wood knew that his brother was the real party to the said transaction, and that hin name was purposely concealed to prevent a discovery of the said fraud. That allowing five dollars apiece for said boxes, and that four thousand were wanted, the amount would be but $20,000, whereas at $16 a piece the sum of $60,000 is to be taken out of tbo city treasury in fraud thereof, and to the groat injury of the plaintiff and all other taxpayers of the said city. The plaintiff there fore prays that tbe said coutract, for tbo frauds herein alleged, may be set aside and held for naught, and that the said Fernando and Benjamin Wood and Samuel C. Jollie may answer the premises and bo restrained from prosecut ing" cither the Board of Police Commissioners, the Mayor, Aldermen and Commonalty of the city of New York, or the Board or Supervisors thereof, Tor or on aecount of the said contract, or of any hallot boxes delivered thereunder, until tho further order of this Court in the premises.
