It waa evident that Owight waa to eejoy eome mysterious advantage from the leoae; bat the facta ahowed in evidence that Height's motive waa one of revenge for Brown'a aurreadering him to the Sheriff and having him aeat to prison, and Um nut tbe malice. He pumanee mi. Brown oy putting in this answer, charging him with a fraud, and connecting bis respectable firm with what had been acknowledged by the whole community aa a fraud. He charged that the ncost respectable Arm to the United States had attempted to foreclose hie family home on a pretended indebtedness. He thought it was a oaae of the moat wilful and corrupt perjury ever brought before a magistrate. Mr. Hall elaborated the idea that the charge of Dwlght against the Browns of obtaining this lease, was a dishonest one; it was an astounding charge of fraud, and just such a one as a men would resort to in revenge for having been cast into the debtor's prison of this county. He had no doubt that Spencer was the nominal lessee of the road Tor some rail road sharks or other ; but that he was the nominal lessee of n respectable Arm wan n malicious charge. Mr. Hall then proceeded to show from the evidence of Mr. Brown and others that the facts alleged in Pwight's answer were false. Where the allegations were not legally false, they were nncommercially false, and malicious as a mere naked Ue. Mr. Brown's testimony, he contended, proved that the allegations were wholly and absolutely false. With regard to the annexed answer, he would any that there waa a flight of Mr. Spencer after he made the memorandum. Judge Russell Said that he would deny the motion to discharge, but would bear any evidence Mr. Stocghton bad to offer, and would allow him to renew the motion afterwards. Though he thought a prima facie case was made out, ho would prepare a written opinion at the end ot the case. Mr. Stoughtonsaid that the case waa too grave a one to be dwmtsaed in that way. He denied that the question before his Honor was whether there was probable cause to believe Mr. I > wight guilty of perjury, but whether there was probable cause to believe that perjury bad beea oommitted at all. and if no whether the defendant com Blued it.
