6 TU* Rlfkl mt Wmy. > ^ TO TilK XUITOK OF THB HlkiLD. New York, July 3, 1865. In your isaa*of the 2yth ult., in an Article headed "Who has the right of the way?" tout eorreapond?nt make* utatemrntft at variance with the facte, which are limply these:?My horse and cart were standing hooked and tied, an the law direct*, on the stand assigned me by the Mayor, and with the approval of the tirin occupying No. 13 Beekmun street; had stood probably half an hour unemployed, the cars and other vehicles passing and repassing without inconvenience, wtien a car stopped directly abreast of my cart. The conductor leaving his platform attempted to lead my horse ahead to tuaku ream, not for his car, but for ther carts coming up that properly belonged on the right hand side of the street and not on the left where he proposed to bring them. At this juncture policeman (No. 1,750) came along, ordering me to move my horse and cart, and, on my refusal to do it, began to untie to move him, which I forbid. He still persisting I simply took him by the arm and told liim to leave the horse alone, as lie conld *ot move him? this is the sum total of my violence?when he turned on me, seizing me by the collar with violence enough to wrench off the button, and, drawing his club, would probably have hit me had not the bystanders cried sliame. I then went with him to the station house, and after one or two hours' delay was taken to the Tombs, before Judge Hogan, who, after hearing the policeman's story, told me to go about my business. Much has been said of late about arbitrary arrests. Mr. Editor, what do you call this? The car, by simply stopping one length sooner, would have left ample room for all to pass, and as there were bat two carta coming ap it would not have taken long. It was only a few days ago my cart stood quartering, putting on a load, when a car coming down near the aame place the driver never broke up or tried to stop until the boom of my cart had passed through the car, putting my horse in a very uncomfortable position. One of my young men is now laid up, and probably maimed for life, by a oollision plainly chargeable to the manner of putting down rails, switches, and turuouta in our public highways?or do they cease to be such as aoon as a company can succeed, either fair or foul, Bights or Sundays, in getting down a track? Mr. Right of way thinKa it a question ror tne lawyer*; I think it a question for common sense and reason. And for my part, in this affair 1 am willing to leave my cause, or rather our cause?as all draymen are deeply interested?before the bar of public opinion or before a competent jury of our fellow citizens.
