ecclesiastical dlttlculty by the publication, by
order of the imprisoned Blsnop of Para, of au ex
tensive pastoral to his parishioners, and by tils
commanding, in direct defiance of the claims
sustained by the civil power, in virtue or the con
sututioa. the reading, from all the pulpits of his
diocese, of two letters addressed to him and his
follow prisoner, the Bishop of Oilnda, by Ills
Holiness Plus IX., In which letters the Pope ap
proves of the course of the bishops, gives
them the Apostolic oie-slng, and declares that he
had been deceived by the Brazilian envoy
sent to treat with him on the religious question.

A tragedy occurred last week on board the ship
Ring Pniilp, trom Cardiff lor Valparaiso, how un
dergoing repairs here, whose crew, ull but six,

two mates, the Biewaru, three seamen and tho
cook. On tho 28th, wuen captain Kawlins went
aboard, lie iound the quarterdeck stream.ng with
blood, the stewaid dying, the three Xiamen lying
on the deck seriously wounded, and the two mates
engaged in a death struggle, lie attempted to
paciiy them, hut his efforts appeared only to excite
their lury lurthei. lie proceeded, therefore, to
the United muicb flagship Lancaster, whence
a party was despatched who seized the two
maies and handed them over to tho Brazilian
police. According to the story ol the.secoud mate,
Thomas Murray, and the three seamen, tho llrst
nmte, W. P. itjrne, got luriously drunk, quarrelled

the head with a revolver, iracturiug nis skud and
causing his death next day. lie then turned on

A slight earthquake occurred October 30 at

Kupreme Court, eiven by Mr. Justice Westbroofc, that

I transmit Judge Westbrook's opinion, with the opin
ion ol Me-srs. Nnsli and Davies to the sumo effect. I re
gard these three opinions as unanswerable.
I also enclose the printed opinion ot Mr. Sterne and
his printed argument.
I think li igation here is a most causeless and useless
expenditure ot public money.

same was progressing before the supreme Court I read

impressed with ilie reasons assigned by liiiu tor the con
clusion at which lie arrived. Tnis opinion, together

now lor the first time communicated to me, leave in my
mind no doubt as to the course which it is the duly of
the olheers ot the city to follow in the matter. '1 he law
relating lo the Improvement should be carried out In
good laitli. and the litigation stopped.
While 1 sympathize with the ilci-ire so strongly felt and
so olten uianllestcd bv m.v predecessor, to reduce by
every luwiul means in his power the burdeps of the city,
1 am ol opinion that, in this imrltculnr insuuee, the liti
gation ou his part was u mistake.
't he improvement of Fourth avenue was commenced
with the approval ?( the city. The necessity (or some
such improvement was generally acknowledged, and the
prosecution oi the worn was actively promoted by all
parties w ho felt the incoitvenl n e and were exposed to
tne dangers resulting tri m the pre-existins state ol mat
ters. There are tew persons in the city who are not de
airotis that the work should be completed as speedily as
possible, aod when completed there can lie no doubt but
that it will he one id the grcate-l public impro\cmenu
and benefits secured to the city of Is c years.
No person has suggested, so tar ?s I know, that in the
matter ol this improvement or in the manner of it* ex
eoution any wrong or Imposition Ims been practised
upon the city. As so prooerly urged by Ju ige West
