10 THE EMMA MINE. Ex-Senator Stewart Before the Committee on Foreign Affairs. DETAILS OF THE NEGOTIATIONS IN LONDON. Mr. Lyon on Professor Sillimun'i Explanation of the Famous Telegram. Washington, March 21, 1876. Before (be Douse Committee on Foreign A flair* to-day ex-Senulor William W. Stewart testified Mi at tie first became acquainted with Mr. James K. Lyon in March 1871, when be was introduced by Mr. Chaffee, Delegate u/tiA it.fV\rr>NA.t him that Up V .. cluim to the Emma Mine, in Utah, and sought to Interest hint in Lyon's behalf. Mr. Chaffee also told him that if, on investigation, he should Oud the claim to he a meritorious oue, ho (Mr. Challee) would furnish' funds to carry on the litigation which might bo ucccs nary to enforce the claim. Mr. Stewart then detailed tho circumstances ol attending tho litigatiou. lie corroborated the statement of Senator Morton as to Ills proposed cunnocllou with tho matter, and gavo it as his beliol that Judge McKoan was an honest Judge?a belief which lio had formed since the tcstiniouy of Mr. Lyon, as ho felt now convinced that the statements of Mr. Lyon, which had led him formerly to distrust and opposo Judge McKoan, wc-ro entitled to no credit whatever. The Senator gavo a history ol the course ot the litigation, in which ho engaged, as counsel lor Mr. Lyon, with reforeuco to the Emma Mlno, and slated that lie had ulwayg sought to promote Mr. I.yon's Interest. The wituoss then spoke of tho opening of negotiations through Mr. I'urk lor tho sale ot the inlut', und said, "1 wrote a letter to Mr. Lyon, to which lie referred in lils toslimouyIt is , ns lollnu 4 ? It is uol as good as I tried to get; but, alter three days ol talk, it was the best 1 could got. The plan lias this advantage, that wo will not be lighting lor a worked out miue. Tho litigation will not bo injured, and II wo gain the caso wo shall recover something, besides the right to briug other lawsuits. They have worked the mine up so in Kiiglaud by tho ore they havo tent and tho manner ol sending it that I have no doubt ol u sale ol from $5,000,000 to $8,000,000. 1 have seen their correspondence with the two Knglisli houses to I whom they sent the ore. They are crazy about the j mine. The Kmmu party have been working alt the liine to put up the reputation ol the mine. 1 have relused to give up the lawsuit under any circumstances, unless you get $000,000. You will without doubt gel that. WSl. II STKWAUT. j This 1 seut to him, and he perfectly understood my leaning. In answer to a question, "Does that refer to tho lutma Mine?" ho (Lyon) answered, "Certainly; ho regarded It as worked out;" now Mr, Lyon knows very sell that that is not true; that the letter had lulorcnco to our repealed conversations aud efforts to got an injunction; there were frequent conversations between us, and 1 had said to him that the mines woio liable to bo worked out; thoro were six !>r eight, or, possibly, ton years of litigation before us; wo wore speuding Mr. Chalice's money, and I lelt anxious on that account to settle the matter; ho told mo thai he believed 111 the mine, and I certainly believed in it as a very rich one, but, like all llrst class mines, I kuow It was liable in tho course ol limo to ho worked out. Hero Mi, Stewart gave a brief history of several noted mines which had yielded largely aud had been of great value, but which had at last bccoiuo exhausted. Among such mines ho uamcd the Ophir and the Could A: Curry. In reference to tbo above letter Mr. Stewart said:? "Hits was a hurried letter. In relerouco to tho m .uuer ol seudiug the oro, my recollection of the meaning of the words ' Is this?that the ore was very publicly sent; It went by the Cunard steamers, and the mine was advertised by that lact. The ore was also shipped to two proiniuenl houses, Hath & Sou and Lewis ,v Sou. "Whnt does this mean? Wby have you brought us?" Coates could nnt give any satisfactory account ol it, and Park w as getting indignant, and there seemed to be a sort of "Comedy of Krrors" being played thereat a very rapid rale; they did not sceiu to understand each other, Mr. Grant then touched Mr. Park on the boulder aud called hint undo; in a few lumuies they ranie to me, and Mr. Park introduced me to Mr. (Irani. The witness then detailed the negotiations had J with 1'ark to induce him to buy out Lyon's interest, l'ark finally proposed that ho should make a proposi lion to the stockholders in America to give him a percentage ol their stock and sell it out, and If they consented ho would advance thu money to huy Lyon out. As a result the American stockholders readily signed tho contract. The reason of their readiness ho afterward louud lo bo that tlioy were interested in another company, called the Illinois Tunnel Com|Mtny, which was then mining a tunnel in tho ground claimed by the Kmma Mine Company. The witness proceeded:?Then we hud to figure up ' what should he allowed tor the Lyon clam; ol course having bud to take all the chances ol the Lyon claim I wanted to get as much us 1 could and I told them (the stockholders) that they ought to give Mr. Lyon as much us onu-lcnth, and Dually 1 got then to agree to that one tenth, which would be 5,000 shares; ! then 1 signid thecbutract with Mr. I'urk to take Dlty , per cent on the 5,000 shares; Mr. Lyon says 1 did that [ us u "decoy duck," but 1 deny it entirely. Mr. Hewitt?Mr. Lyon in his testimony says that you told linn, " We gave Geuoral Schenck 500 shares ol stock." Did you ever say such a thing to him ? Witness?I did not; 1 deny it most emphatically ; I | never told him anything of the kind. At this point (he committee adjourned. A LETTER FROM MR. LYON. To tbe lion. Tuosias Swamn, Chairman of tho Comin it loo on Foreign Relations:? Sir?1 have rcaU the letters of Professor B. Silliman, of the 12tb aud lSth lust., in which he seeks to explain a certain telegraphic report signed Williams, Silhmuu iiml llu.ssey, communicated to the Knima Sliver Mining Company (hunted) ol London, and received there April 6, 1S72. Profossor Silliman seeks by these letters to cliango the import of the despatch, and thus oxocerute himself from the respopsibillly that attaches to bim as being one of the authors of such u monstrous uud untruthful report. In order that you may have this telegram under your eye, to be read in connection with this letter, 1 quote us follows:? Very great improvements since lust report. On seventh floor drifted 120 feel, mid ou tenth Moor 40 feet, all in ore. At bottom win so, 70 feet below old workings, drilled 4u feet, all in ore. Sample assays, 2* per cent lead and (2,000 silver. Reserves discovered since lust report, over 8,000 tons. Everything connected with tho mine Is highly satisinctory. Mailed supplementary report. Canyon road still bail. Shall forward 1,000 tons first class ore forthwith. Have 06 loos bullion, wortli (20,000. Propose gulling here. Will report Hilly on return. WILLIAMS, SILL1.MAX AND HUSSEY. You will sec that this report was sent from Salt Luko City, Utah, uud that it was subscribed by "William* Silliuiun and Hussey.*' Tbe first named, it will be remembered, is E. tirydges Williums, M. P., then ono of the directors uud vice president ol the company, who was employed by Mr. Tronor W. Park, then in Loudon, to visit uud rcpurl on tho Emma mine ou the following tortus?viz., ?6,000 in cash, paid to linn oil his departure ironi Loudon, and u CHll UU Mr. IIIIK 1UI O.UOU Mi ll OS Ol IIIO stock ol the company ut ?20 per share. Tins celebrated aud disinterested expert was joined in New York by ex-Seuutor Stewart and Professor Sillliuan, ! . who accompanied him to the mine in accordance with , the prearranged plan ol Mr. Park. It never has trans- ! pircd why ex-Senator Stewart's name is wanting to this report, lor ut that tune he was also a director of tho company und proteased to he the owner of 6,000 j ! shares ol "its slock. Warren llussey was the miuo 1 i manager, aud then also owned a,ouO shares. The l'ael that this despatch was transmitted to I j Loudon has never boon questioned, nor has it ever I I been denied that by a remarkable coincidence it ur{ rived there ut the proper time to assist in the sale ) id 8,&lKl shares of stock controlled by Trenor W. Park, advertised to occur on the following day, which wore subscribed lor and sold through the l.oudon ui.d Westminster liank ut ?23 per share. 1 iusist that this pupcr bears no dilllcult or doubtlul construction. It is short and terse and mouus exactly what its authors Intended to convoy to the minds of n's readers in Loudon, This is the despatch referred to in uiy testimony belorc your committee, as printed ou pages 10 aud 32. und is tho same ol which 1 presented a copy, und I submit, sir, that the construction of it us presented in my testimony is the only reasonaide, rational reading that can he given to the paper. 1 It means that large bodies ol rich oro had bccu discov- ; | crcd since l'rolessor Silliman's last report of February J'J, 1872. by sinking shall* und winces, and by driving udits which lie reported had been sunk aud drivcu all 1 in ore. It muuus that a sample ol these rich ore j discoveries assayed 'J8 per cent lead and $*2,000 per ton in silver. It nieuns that the reserves thus dis! covered iniiouiilcd to 8,000 tons of ore (hat contained '28 per cent lead and $'2,0b0 In silver per ton. It means that the recent discoveries, uggrvgalcly estimated, were 1 ol the value ol $lti,U00,00U | Itciorring to Prolcssor Sillmiuu's more extended ro' port, a copy of which he lias placed belorc your com1 in 11 tee, bearing date Malt Luke City, April 2, 1872, 1 Hud the l olio wing imrugraph:?"An approximate ' estimate of the amount ol ores exposed by these severul explorations show that there are over s,0o0 , tons und there muv be much mure; cross cutting only | can llx the umounl In excess ol this estimate." Now, sir, il this exti aordiuury valuation of uiiuorai, iweuty| eight per cent lead and $2,000 silver per ton, does not upply to the 8,000 tons of oro reported to have been i thus discovered in the Kuima mine to what ores or 1 mines does it apply? l'rolessor sill.man further says | tu Ins letter ol the 12th lliut it Is evidcul that this dcspulcn did not materially atlucl the price ol Emma i shares on tho Lotidou market between tho 17th of March and tho 13th ol April, 1872, because tbc price of tho shares did not dur1 Ing that period lull below ?23 or exceed ?24 , per share. My reply to this is. that between April t) and \prll 20 Mr. l'urk sold tho 8,600 shares subscribed I for on the lormcr day at ?'23 |>or share, and he ulsosold about 8,1X10 additional shares (und 1 have seen the uc count sales), thus realizing tho equivalent of $2,000,000 1 in sterling money. It wus not possible lor the pricu of the shares to materially advance while Mr. l'ark was ottering and selling largo blocks ol slock at (he current ! rates. It will ul?o tie observed, by relereuco to Proles- ! sor sillmiuu's letter of the 12th. that the despatch was published In the London J/tinny Journal on tho tith of April, being the same day ou which the 8,600 shares were subscribed. The tmus mission una publication ol tins despatch having occurred, in |>oil)t of tunc, In connection with the sale of the 8,500 shares, shows conclusively the object lor which the r,port wus made. I see by relerrlug to the London Mimny Junrm.il of the 20tn ! of April, when the lull etlccl of the despatch hud been lelt tbrougn the country, and Mr. Park bud ceased to be a huge seller, lliut the price at the shares hud advanced to ?111. 1 would usk why i'rolessor tjilllman suppressed this luiporlant tact in his letter to the committee ? It is scarcely necessary lor mo to give further attention to ('releasor Silhnian's most loolish attempt to change the obvious meaning ot his despatch. His report was obtained lor the purpose ol enabling Mr. l'nrk and his coutoderiite* to sell their worthless shares to the iirillsh public. It well served tbat purpose, and now that the great Iraud ol selling this mine audits shares has been exposed I'rolessor Silhmau inust bear the criticism and < ensure that inevitably follow the present reading ol his uutruilitul and most remarkable reports.
