For Sume time past there has been pending and undecided a foreclosure suit instituted by Duncan and Klliott, us trustees, to loroclose the ttrst mortgage of the company, amounting to $0,000,000. From tho records of the court tiled in that suit it appears that they c aim default to have been made by tho company ol payment ot the coupous duo tu May and November, 1874, and that these coupons are now valid and ou'.siaudtug claims against the property. The/ also tiled a petition lor payment of claims of floating creditors, which was referred. In these proceedings It was made to appear that tho floating debt had boon reduced from moro than $1,100,000 in Juuuury, 1875, to $530,000 at the present time, and the referee made a report authorizing the payment ol $330,000 out of the trust estate on the remaining flouting debt. Tho record also shows that Duncan and Klliott obtained leave to Issue $500,000 of receiver's certificates, to conitituto a prior lieu on tho Income ol the pro|Mirty, and, J the income prove Insufficient, on the ostato itself, to bo paramount to the claim ot the holders of the list mortgage bonds. This leave was granted (there toing no opposition) on condition that Duncan and Klloll file additional security in $100,000, which they lid, giving 8. L. M. liurlow and W. W. McFarlaud as their bondsmen. Tho report of tho referee has not yet bcou confirmed by the Court, but is noticed lor a bearing on tho Oth of April nest. In opposition to tbo foregoing proceedings Mr. Morris Kotchum, tho banker, of this city, who was origiually appointed trustee of tho $6,000,000 tlrsl mortgage, now llcps in at tbo solicitation of the bondholders and asserts bis trusteeship, seeks to oust Duncan and Elliott as receivers in the lirst foreclosure suit, uud asks for the appointment of a receiver in his suit, lie claims that the bondholders are satislled that Duucun and Elliott can give no legal title to purchasers ol tho property under a decree in their suit cvon If they should obtain ono. and that tbo rights of bondholders can bo legally protected only in a suit biought by him. A lew days siuce counsel for Mr. Kotchum mude a motion lor leave to come nto court iu proceedings to remove Duncan and Elliott Irom their receivership. Such leave was granted, and in pursuaueo thereof llr. Ketchuin's bill ol complaint has now been llled. In 180.1, the tomplaini continues, when tho war was at an end, Mr. Kelchum received Ihe first Intimation that these proteediugs had been instituted against him, and that an order had been made therein ousting hun as trustee, or purporting so lo do, on the 7th ol April, I8?I4. Thcso proceedings he churges to bave been null and void, and tbut the Court was without jurisdiction to deprive him of title to the trust property, the grounds for such proceedings being his loyuily to the lawful authority and government of the territory where ihe Court was anting. On or about the 1st of April, 1876, William B. Duncan and Andrew ?. Elliott, of the late llrru of Dunsaii, Sherman Ik Co., boitig then directors of the road, and William 11. Duncan, its 1'rcsident, the latter obtained from Charles Welsh, who had been named a truslco under tho pretended decree of the Alabama Court, a (ortn of resignation, and soon thereafter Mr, Dudcuu procured Welsh to withdraw Such resignation, and it was never accepted; thai notwithstanding said resignation had no validity, Mr. Duncau procured it to be exhibited to O. H. Young and A. Jackson, who bad also been named trustees under the Invalid decree, with a request mat they would likowlse resign, and they did fortuully resign; that immediately thereafter, and notwithstanding the pretence to Young and Jaekson tbat Walsh had resigned, whereby their resignations had been procured, Mr. Duncan procured Walsh to act as trustee and to appoint him and his partner, Elliott, trustees, notwithstanding Duncan was president of tho road, a large stockholder thereof, and represented unsecured and Healing claims ol Alexander Duncan, his lather, or other parties, which claims are in direct hostility to the rights of the first mortgage bondholders. All these proceedings Mr. Kelchum has ignored, and claims that he has always acted us. and of right still remains, trustee of the property ol the company to secure payment of its ti^il mortgage bouds with interest, and as uch lias acted in concert with h .scestuia que trust lor the protection of the rights of the bondholders. A few days ago there was published in the 11 kkxi.d the conclusions arrived at by Judge Weslbrook as to tho motions made bolore him on the Tweed $6,000,000 suit. One ol these motions was tor an cxira allowance i to tho prosocutiug counsel ol one per cent on the amount of the judgment. Two motions wure made on Mr. Tweed's boball. oue to have the exceptions heard lu tho Urst instance at General Term, and the other ior a new trial and stay of proceedings. Judge Weslbrook yesterday gave a writton opinion elaborating (be grounds of his conclusions as already published. On motion lor settlement an order embodying these eon elusions will be proposed and submitted. THE LOST HARVEST QUEEN. In the matter of llio libel of Charles XL Marshall and others against the steamship Adriatic, of the White Star line, to recover the value ol the American ship Harvest Queen uiid cargo, alleged to have been lost in the Irish Channel on the night oi December 30 and 31, 1875, by collision with the Adriatic, the attorneys for the claimants have tiled an answer in the United States District Court, boioro Judgo Ulatchlord. Tho answer avers that tho hull ol the vessel, which is supposed by the owners ol the Harvest Queen to have been that ship, did liot conic in contact with the hull of the Adriatic, and that the vessel's beam passed the quarter ol the Adriatic aud her light! disappeared, alter which her loom was distinctly visible Irom the bridge of the Adriatic as she sailed away to the eastward. THE DOCKliAY CASE. Mr. Frederick A. Dockrsy, who waa Collector of Customs at Jacksonville, Flo., in 1800 and 1870, and who went alter that time lo Cuba, Spain, and become the object of much diplomatlo correspondence, left this city last night, in company with United States Doputy Marshal McMurray, of the Northern district of Florida, to answer uu indictment lound there against bun by tho Umtod Stales Grand Jury on December 1, 1873, lor relalnlug unlawlully $3.700. alleged to be duo to tho United Stales as fees. Mr. Dockray came from his borne in Bridgeport on the receipt of a telegram from tho deputy marshal requesting his proseuce lu New York, audi waiving an examination, woul before Judge Ulatchlord, who issued a warrant lor his return to Florida. The indictment was framed, it is said, not ou tho complaint of the United Stales, but of one of Dockray's lormer bondsuicu, Dockrsy haviug declined lo pay the said amount of fees received by bltu into tho Un'ted Stales Treasury, after consultation with the Supervising Agent of the Treasury and the ex-Attorney General Williams, until a similar case, pending In Ohio, was decided. That suit was decided In 'tavor of the Collector. Tho Jury in Florida decided that the Ohio decision did not spply in Florida. THE HARLEM MURDER. The Grand Jury yesterday louud an Indictment for murder in tho first degree against Thomas J.
