A subject of lengthy argument yesterday in Supreme Court Chambers, belorc Judge Oonobue. wits a motion In tbo suit brought by Charles Devlin against the city, the Board of Supervisors, Attorney General Kairchild, Corporation Counsel Whitney, Jackson S. Scbultz, John H. Keyscr, Andrew J. Garvey, Richard U. Connolly and James 11. Ingcrsoll, for the appointment of a rocciver of all the claims against certain ol the dofeiulunla who are charged with having through conspiracy obtuined large sums from the city and county treasury. Iho appointment of such a rocciver Is asked for, that ho muy prosecute the ullogod conspirators aud their estates and thus endeavor to obtain a restoration of the sums of which they have dclruudcd tho city ami county. Too court room was thronged, aud the arguments ol tlio respective counsel wero listened to with great interest. )fr. Dudley Field aud Ex-Judgo Uosworth uppearod lor tho motion aud Messrs. Wheeler II. rockhutu and Cburloa O'Conor appeared In opposition, although tho latter gentleman, to the great disappointment ol many present, did not participate lu the argument. Tbeso embraced a statement of the bases ot tho suit, which wore stated to bo negligence of prosecution of various members of the old Court House Ring, uud tho fact that the statuto of limitations would soon bo u bar to any prosecution of these casos, and that this suit was the only possible method for obtaining a restoration of immenso sums out of which tho city and county were defraudeu through such alleged conspiracy* In opposition to the motion was read a very lengthy fttluavit by Mr. Pocltham. This was nothing more nor less than an epitomized history of the King suits. It was a pretty old and familiar matter, and yet tho recital of the details, while on the <m? burnt us interesting as tho graphic story revealing tho hiddeu history of tho gunpowder plot, seemed almost a marvellous counterpart of tho Arabian tales, suggestive of All Uuba and Aladdin. It is unnecessary to recite these iumiliar (acts. So "open sesame" over doveloped such splendor of riches Mr. Field made tho opening argument. He began by readlug the act passed by the Legislature in 180U, under which the present action Is brought, such act conferriug the right upon any taxpayer lu the city to Institute such proceeding. .Mr. uuvnn. us u taxpayer, he claimed, was authorized to bnug the suit, and tho bona lldcs of the suit was not a mutter to he considered. The object of the act wus to encourago just such actions. The suit was not brought In any th rd party's interest, hut to bcncllt the city. Mr. Devlin did not waul any receiver on his own behalf, anifthoro was no imputation on Mr. Kuirchild or Mr. Whitney, who recently bernmc olllcials. and tho suit was not brought against thctn in any offensive sense. It was now 187U; the frauds worn discovered In 1871, and there wus practically nothing done about these claims. The Attorney tioneral and tlio Corporation Counsel wero the one- who must put the machinery in motion. If these suits were not instituted pretty soon tlicy would havo to be dismissed lor waul of prosecution. 1 be parties whom they sought to prosecute still had in tlioir possession tBeir stolen money, and the object of the present suit was to compel lis restoration, and tho only effectual way to do it, ho Insislod, was by the plan proposed, the appointment ol a receiver. Mr. Pcckhum, in a lengthy response, claimed that this action wus Lrought not in good latin, and that Iih tbjcct was not to hcnotlt the cttv, but to hulp Mr. Tweed. While the statute wus all right, he Insisted ihut it was discretionary w ith the Court as to allowing my such suit as the present one to be prosecuted luuer such statute. The object ol tlio statute he Muitns was to meet tho contingency of want of prosecution of claims ol this character. In the present cose ho contended thut these suits had been prosecute I with all tbo rigor possible, that n largo sum ban already boen realized Iront the Waisou estate through tucb prosecution: that a verdict for over fii,<100,0011 tad been obtained against Tweed, and lliul suits wero till pending against Connolly and others In Kuropo which were now being prosecuted. The evidence of these three parlies had been received as Slate's evidence, and was a bar to civil though not criminal prosecutions. In the case of Ilelknup, at Washington, it was found necessary to obtuiii the tes iitnony of Marsh, which could only bo procured upon the ossulance of the latter'* exemption I runt prosecution. 80 in pruaecuting Tweed, they had to accept the testimony of lngersoll, Gurvey and Keyser In order to secure Tweed's conviction. Kx-Judge Bosv.-orth followed with quite a lengthy argument In reply to Mr. I'eckhain. He insisted that the motive of the plaintiff was immaterial, and that a party who has a good cause of action cannot ho defeated on the ground that bis motive Is sinister. Ho asked that the act In questtou be liberally construed, as being lor the public bonotil. The papers, he said, showed that Garvev and Key.-cr wore ready and willing to restore their share of the stolen plunder, but no Steps bad been taken to show the amount of their indebtedness or to recover the money they bad fraudulently obtained, llo contended that the receiver need only look alter these small sums, whilo llio opposing counsel could prosecute the larger claims. All they wished to do was to wake up the sleeping municipality and recover moneys which otherw ise would he lost to the city and couuty treasury. Judge Honohue said that he ;?w no necessity of giving the mutter any special consideration. The case, In bis view, was a very clear odc, and. being left discretionary with the Court, he tegurded it his duty to deny the application, and directed an order to be entered to this effect, AN IMFORTAN'T MINING SUIT. A salt to recover $1,200,000 has been brought by tho Union Consolidated Mining Company agdnst Jul.us E. Raht and others. The basis of tbe salt is un alleged conversion by the defendants of a largo quantity of valuable ore In tho platntifls' mines and misappropriation of tnonoy and securities. Mr. Kaht, it is lurtlicr averred, was for sixteen years a superintendent in tbe uunes of the l"nlon CoosolWated Mining Company, and the alleged conversion took place while ho win acting aa the agent ot the company. An attachment was obtained by the plaintiffs against Mr. Rahl's property In tliia city, on the {round that he was a nonresident debtor, lie betug a resident of Tennessee.
