AN IMPORTANT EXTRADITION CASK In the case ol the application for the extradition of Leopold Nettol, a native ol Anstria, by the Austrian government, through Its Consul at this port, for an alleged offence against the laws of that country, Commissioner Osborn decided a few days since that the prisoner must be held under tho Extradition treaty. Kx-Jndge Joachlmsen, counsel lor Nottel, excepted to the decision, and made application yesterday, before Judge tilatchlord, in the United States District Court, for a writ of habeas corpus and certiorari. In his petition Nottel sets forth that the Commissioner admitted illegal testimony; lli.it no evidence was given to prove forgery, the offence allegod; that proofs ot the alleged forgeries were not produced; that tho papers put in evidence showed ihat the prisoner was wanted on a charge of fraud, not to meet a charge of forgery, and that fraud is not an extraditubio offence, and that ho should not be held here or extradited on any proof whatsoever of such an offence, if even such had beou committed by him; that no warrant of arrest was issued by the Austrian government at the time ol Mcltel's arrest here nor since that time, and that tho Commissioner erred ill udmitting evidence ol Nettei's religious belief with ' a view of impeaching his credibility on onta.
