tho death ol Otllcer Kdward Scott, of tho Fourth precinct,

August Scliliomann knew the deceased officer; when
witness was closing his store, a lilllo alter twelve
o'clock on Sunday, July 2, he saw lbs officer coming

other; witness next saw iho officer from his
window, talking with two colored persons; the deceased
then wont toward Steuben street; shortly alierward
witness saw a man fall to the sidewalk beside the
puuip, near Myrtle avenue and Utenbeu street; thero
was a large crowd in the vicinity at the time; did not
hear any noise or disturbance of any kind; the only
one witness recognized wits Hubert Conroy, who was
dragging the deceased along the sidewalk a: tor be had
been knocked to tho pavement; witness asked Conroy
where he wus taking the officer; Conroy said "l'oit
drugstore;" there was another mail helping Conroy,
hut witness did not know him; thero were not many

examined, but their evidence was ot alight importance

Tho inquest was then adjourned until next Tuesday.
THE BEATTY SHOOTING CASE.
Sergeants Calu and Kaeon, of tbe First pollco precinct,
Brooklyn, were Before tlic Police Commissioners
of Brooklyn yesterday, charged by Captain Smith with
noglect ot doty in relation to making arrests when Ollicer
John hcatty, of that precinct was shot.
The evidence'was very attentively listened to by the

In a suit for divorce, brought by Elizabeth L. Raymond
against 1/Cwis 11. Raymond, an order to show
cause was granted in October, 1875, wliy the defendant
should not pay certain arrears of alimony. It is
claimed by the doiendant that he had obtained a release
in full from the planum, who ,n turn answered

In a suit brought by Thomas H. Harding for divorce
from June K. Harding, on tho ground of adultery, a
motion was tnado vosterJay In Superior Court, Special
Term, before Judco Curtis, to confirm the referee's re- j
port, wfinch was in favor ol the plaiollfi. The motion |
was opposed by defendant's coat-sol on the ground that i
the evidence was incomplete; lhat ibe plaintiff having
discovered the alleged adultery on the Hist of July, auil :
snot tho alleged seducer three days later, did not port
with his wife until August 3, and even then, according
to some ol ihe evidence, very reluctantly, and that ho
subsequently promised to marry liar. On the other
side it was claimed that tho evidence was us elear,
strong and conclusive as evidence in such eases could
be. Judge Curtis took the papers.
Kebecca Hums commenced proceedings for divorce
from her husband, Louts H. Hums, ou tho ground of
adultery. The cause was referred to Knfus K. Andrews
as sole referee, E. E. Price appearing lor the
plain HI). The releree decided in favor ol the plnintilT, and
a motion was yesterday made before Judge Westbrook
by Colonel lie >rgo U. Hart In bebalf of tho pluintilT lo
confirm the report of the referee. Judge VVestbrook
took the papers.
AN IMPORTANT EXTRADITION CASK
In the case ol the application for the extradition of
Leopold Nettol, a native ol Anstria, by the Austrian government,
through Its Consul at this port, for an alleged
offence against the laws of that country, Commissioner
Osborn decided a few days since that the prisoner
must be held under tho Extradition treaty. Kx-Jndge
Joachlmsen, counsel lor Nottel, excepted to the decision,
and made application yesterday, before Judge
tilatchlord, in the United States District Court, for a
writ of habeas corpus and certiorari. In his petition
Nottel sets forth that the Commissioner admitted
illegal testimony; lli.it no evidence was given to prove
forgery, the offence allegod; that proofs ot the alleged
forgeries were not produced; that tho papers
put in evidence showed ihat the prisoner
was wanted on a charge of fraud, not to
meet a charge of forgery, and that fraud is
not an extraditubio offence, and that ho should not be
held here or extradited on any proof whatsoever of
such an offence, if even such had beou committed by
him; that no warrant of arrest was issued by the Austrian
government at the time ol Mcltel's arrest here
nor since that time, and that tho Commissioner erred
ill udmitting evidence ol Nettei's religious belief with '
a view of impeaching his credibility on onta. Prisoner's
counsel sustained tiic points in the petition in a
lengthy argument, which was replied to by counsel lor
tho Austrian government, Judge Blatchford reserving
decision.
PACIFIC MAIL 8TEAM8HIP COMPANY.
Suit has been brought In the United States District
Court against the Pacific Mall Steaibsbip Company to
recover duties alleged to bo due on marlno boilers,
cylinders and other machinery imported by the company
for the equipment of the steamship Colorado. Tho
machinery on which the duties were levied was made in
(llasgow anil was imported January 16, 1873. Tho company
refused to pay duty ou the ground that under un
act of Congress marine tnnohiuery was exempt, Mid
the govermeni, through Colonel Bliss, takes Issue. The
amount claimed is flu,988 40 and interest from March
'JO, 1873, and costs in gold.
WESTERN UNION TELEGRAPH COMPANY.
In tbo Injunction proceeding brought by James A.
Dowley' against tbc Western Union Telegraph Company
to prevent tho company from paying its next
dlvident, payable on the lAih Inst., on the groand that
the saroo is to be paid from the caoital and not from
the protlts of tho company, an order wot granted
yesterday liy Judge Dononue appointing ex-Jadge Peabody
referee, and directing that if the testimony before
him, as sucli referee, is not concluded by the 14th Inst,
application can be made to the Court for further relief
in the premises. Tbo taking of testimony will commeiico
at eleven A. M. to-day, and an elTort will be
tnadi-, U Is stated by the plaintiff's counsel, to put la

SUMMARY OF LAW CASES.
Permission was given yesterday by Judge Westbrook
to the Mutual Lite Insurant* Company to bring
suit against Samuel H. Hurd, receiver of the Third
Avenue Savings Hank, to foreclose sis mortgages
given by tbe bank as security for $19,000.
In the suit?of Kphraim D. Urowne, President of the
Mechanics and Traders' National Hank, against the
city, sucb suit bein - brought as assignee of a claim on
a contract, Judge Wcstbrook yesterday granted an
order directing payment wilbin live days ot $26,549 97,
admitted in the answer to bo due on the contract.
Notwithstanding tho continuance of the heated term
Judge Westbrook continues to hold Supreme Court,
Chambers, from an early till a late hour each dev. The

The funeral services over the remains of Rev. James
Boyce, pastor of St. Teresa's church, corner of Rutgers
and Henry streets, took place yesterday morning. Notwithstanding
the Intense heal the church was tilled to
lis utmost capacity, and thousands remained outside,
unahlo to obtain admission. Tbo deceased clergyman
had labored faithfully lur years in the cause of religion,
being widely esteemed in consequence. Somo fifteen
years ago, woile assistant priest pt St. Mary's, m Grand
street, he purchased St. Teresa's church, then a Presbyterian
o;l Ifice, presided over by Rev. Dr. Krebs. St.
Teresa's was dedicated with ail the pomp peculiar to tho
Catbolio ritual by tho late Archbishop Hughes. Subsequently
the parish grew under Rev. Mr. Boyce's
