The trial of Francis McGuIre for murder In tne sec ond degree was begpu yesterday before Judge Suther land and a Jury obtained the previous day In the Court of General Sessions, Part 1. Assistant District At torney Sell, lor the prosecution, placed on the stand two women named Mary Kignoy and Mary McLaugh lin, who bad lived with t be prisoner aud bis wife at No. 330 East Thirty-tilth street, and who testified that early on tbe morning of Sunday, the 13lh of last August, tbe accueod ordered bis wife to arise and got breakfast; that she rolused to do so. stating that it was earlier than usual; that at soven o'clock she did arise, and ball an hour later, having prepared tbo meal In question, eat down to it with her huBbund; that they quarrelled at tbe table and that the husband left tbo bouse suddculy and did not return till about nine o'clock lu tbe evening. When bo then returned, according to the further testimony, some angry words passed betwoou Dim and bis wife. Tbe latter made sotno allusion to another woman, aud McGuIre retorted, "11 you aay that again I'll kill you." A momout Inter Mrs, Molluiro cried, "l'ui stabbed I Help mo!" Upon examination it was found that sho bad been stabbed in the abdomen with an enormous butcher's knife, which bad been lying upon u table in tbo room. They placed upon iho stand an uuut and a sister-in-law ol tbo prisoner, who, on being examined by Mr. Kiut zing, l' stifled that the latter had on tho day in qucs lion culled ul their respective homes, in company with bis sou, a boy of twelve, aud bad drunk lrceiy of beer and ale. At tbe close of tbe testimony Mr Hall nmdo a long and able address to tho jury, summing up the case, and Ibe hour being then rather lute, the Court adjourned until this morning, when Mr. liell will suut up lor tbo prosecution. RAPID TRANSIT AND THE BATTERY. Among tbe opponents to tbe extension and comple tion of tbe New York Elevated Kailroad who pre sented themselves to oppose its work last sum mer wore Jeremiah V. Spader and tbe Nluth Ave nue Railway Company. Tho Ninth avenue company opposed the work lu the Interest of Us horses aud Mr. Bpader In the interest of himself Judge Van Hocsen, of the Court of Common Pleas, decided against tbo horses, and now Judge Curtis, of tbe Superior Court, Is called upon to decide against the man. Tbe suit Is brought by Mr. Spader, who resides at No. 3 Bridge street, in eqclty, to perpetually enjoin the New York Elevated Railway Company from extending It* line across the Bsttery grounds. His right to this form of relief tbe plaintiff bases on tbe grounds that wnen be purchased tbe property in Bridge street It came to him through an Intermediate conveyance Irom tbe city, in Which waa contained a covenant that what was then tbe Battery should not be converted to private uses; that delendant, tbe company, baa no legal authority to build the road, and tbat tho authority given it by tbe Park Commissioners Is Insufficient to autborize the use of tbe Battery grounds for tbat purpose. Tbe company answers these claims of plaintiff by tbe alle gation* that the company proposes to use the ground between high and low water mark and below low water mark, wblob ground waa ceded to tne oity under tbo Dongan and Montgomerle charter; tbat the use to be mado of the ground lor tbe purpose of tbe road is a public uae; tbat the Commissioners or Parks had full autbority to grant to tbe road tbe rights and privileges Whtcb they did grant, without lortber acttou on tne part oi tbe city; tbat tbo company'* right as a corpora tion to extend its road la derived from the provisions ?1 tbe Rapid Transit act of 1873 and tbe proceedings had under tbe Mayor's commission authorized by tbat act, and is clearly lawful and valid. Messrs. John K. Psrsons and Wheeler H. Peckhum appear lor Mr. bpader, and Messrs. ex-Judgo Kinott. A. J. Vander poel and Edward C. Oslavan for tbe Elevated Railroad Company. Tbe evidence introduced yesterday, though wholly documentary was quite intereeling. Mr. Krvio, the opening witness, presumed somo of tbo old maps or tbe Battery and vicinity, tho earliest map beariug date 1728. Next follows a map ol 1767, and then one of 1770?a centennial exhibit, as one of tbe counsel facetiously termed it. There was also produced tbe survey of C. T. Goerck Id 1701, together with a survey of Gerard Baucker, giving more especially the outlines ol Fort George. A glance at those eaily maps and surveys presented a somewhat different scene from tlial presented at the Buttery to-day. In connec tion with them was also produced from tbe mustv records of tbe County Clerk's office two deeds, tbe lirst, bearing date in 1813, was of a portion of tlie government land to lb* Slate, and tbe aecoue, placed on record two years later, was of tbo residue ol tbo gov ernment land to tbe Htute. Through tbo unearthing ol these deods It was shown that tbe lot now known as No. 3 Ridge street, owned by Mr. Spader, was deeded to the Stato, by which it s claimed it waa in turn d< eded to tbe Mayor and commonalty or tbe city, and thence deeded to tbe parties Irom whom Mr. Spader derives bl* title, with the proviso, as Mr. Spader claims, that the Battery adjoining should never be do voted to private uses. The trial promises to occupy several days. SUMMARY OF LAW CASES. Julius Solmson obtained yesterday, in a trial before ludgo Donahue, holding Suprome Court, Circuit, a ver dict for $6,147 30 against Albert Elsberg. The suit waa oa promissory notes. There was tried yesterday, before Judge Larremore, holding Supreme Conrt, Circuit, tbe suit or Charles A. Harrington against the city for stooe furnished tbe Department of Docksi A verdict was given for the plaintiff for $6,000 12. Tbe suit ol William S. Snebley against Sheriff Con ner, tried before Jndge Larremore, holding Supreme Court, Circuit, for damagos on account of tbe sale of the furniture of tbe Mallby House, a verdict was yes toAay given for $2,620 for the plaintiff. Anna Rose baa brought a suit against tbe New York Gaslight Company for damages to her property on sc count of Its depreciation in value through erecting in tbe vlclalty tbe gas reservoirs and other structures or Ik* company. In Suprome Court, Chambers, yesterday, belore Judge Barrett, there was a protracted argument upon tbe question of granting a lease ol the Stalen island Ferry Cowpany to William G. Starln, tbo bighoal bid der. The Court took the papers. George Nowcomb sued lor $2(1,000 damagos against John R. Kerry, for alleged malicious prosecution. The ease was tried yssturdsy, before Judge Sanford, of the * Superior Court, and resulted in u verdict for $600 for tbe plaintiff. Tbe Supreme Court, General Term, yesterday granted an order to show causo why Joseph S. Kidgeway Should not be disbarred. Tbo order was made return able oo Saturday. A number ol similar cases depend upon this one. Patrick Lavelle was arrested yesterday on a charge of interfering with Election Inspector Bloomer, of the Fifth Assembly district. Ho wua taken before Com missioner Davenport, and held In (2,500 ball to await the action ot the Grand Jury. Lavelle Is tho man who had tho Inspector arrested on the charge of stealing his naturalization papers, the Inspector being held in $600 ball by Justice Btxby, at the Tumbu. Tbo tailor store of Jacob Ulrlch, No. 492 Broomo street, was broken into upon the night of Sunday last, and clothing to the vulue of $300 was curried oir. Cap tain McDonnell, ot .the Eighth precinct, arrested on suspicion a Swede, namod George Williams, at No. 200 Sohth Fifth avonue, where ho also recovered the goods, which were promptly restored to the owner. From Williams ho also pumped lalormation which led him to arrest Joseph Jerolauio and JoBeph Maziu, Italians, who perpetrated the burglary. The throe prisoners were arrutgned before Judge Gilderslceve yesterday, when thov all pleaded guilty. Jerolnmo, as tho lostl gstor ot the deed, was sent to State Prison tor ton years, and his partner Mazln for eight years, while Williams, who gave the Information, was let off with Ave years' Imprisonment. Eliis Henderson, colored, admitted that on Saturday last he stole a dress and shawl Irorn Mrs. Dearien. of No. 254 West Twenty-first street, by whom he bud been employed as a waiter, and thereupon His Honor sent him to State Prison for two years. John Harris, a sneak thief, who Btole a valise from French's llolol ou Friday last, was sentenced for the same period to the same institution. Oelsen, of No. 1,276 Broadway, was walking through Sixth avenuo, slightly Intoxicated, he wus suddenly attacked by Thomas Degnan, of No, 123 West Thirty-flrst street, Who attempted to garroto and rob him. Mr. Oelsen succeeded In partially froe Ing himself from Degnen's grasp and shouted "Help I" His cry wits heard by Captain Williams, of tho twenty uintli precinct, who seised Degnan and brought him to tho Thirtieth street station. BOARD OF EDUCATION. THE CORPORATE BCHOOLS?ATTENDANCE IN THE EVENINO BCHOOLS?MARRIED WOMEN AS TEACH EES. At the regular lesaiou ot tbo Board of Education, held yesterday, tbo president, Mr. William W ood, to the chair, and seventeen Commissioners present, the City Superintendent of Schools reported that sluee the 16th of September, all of the corporate schools?forty five in number?entitled by law to a portion olthe Edu cational fund of tbo city and county had Iteen visited, exceptiug only the school attached to the House of Refugct The number of teachers employed lathe said schools Is 201; number of pupils on register, 13,110; average attendance, 0,fi38. During the month the even ing schools in lbs eouuty have been organized and aro now in successful operation. Tho average stteudanco during the ttrst week of the session was 0.714, and during tbe secoud week, 0,918. Of the 303 class teachers employed In tbe evening schools 247 were re ported as excellent, 61 as good, 5 as tair and 6 as in efficient. The monthly report or pupils ou rogister lu the day schools on Boptember 1 was 113,670, the aver ago attendance being 101,006, showing an increase of 1,226 over the attendance In September ol 1876. During the Mouth 3,441 applications lor admittance as pupils had been roiuseu fer waut of room. Of that number 1,323 had been made at the schools in the Kiucteentb ward and 207 iu the twenty second ward. A portion ol this excoss ol pupils was caused by the temporary closing of Grammar School No. 7 In the Teuth ward. Very lavorahlu reports have been re ceived lrotn the exauuuiug olficurs in regard to tbo management, instruction uud discipline in the cor porate schools, and no v.olatian ts reported ot tho provisions ot law in regard to sectarian teaching. Mr. Charles II. Limousin, the representative of the Freuch Minister of Commerce and l'ublio instruction, entered the hall at the close ot tne reading ol the abovo report and was lortually received by tho Commission ers. The thnnks of tho Hoard of Commissioners of Ed ucation wss tendered to the Cluliun government for tlie medals and diplomas aw urded by that government to this Board at the exposition held iu Chili during 1875. Oh motion of Commissioner Klamrolh the thanks of thu Board were teudorod lu Miss Elizabeth A. Martin, principal of tho prlmury department of Grammar School Xo. 27. in Forty-second struct, for lier noble, daring and cool courage in saving tho lives of the chil dren under her care when the steam pipe in tho school room hurst about two weeks ago. The Committee on Bylaws, to whom was referred tho matter ol the ad\ inability of r.-u.iiing married women as teachers lu the public schools, reported that they have ^ven tho subject a lull and careiul Investi gation, and are unable to see that any additional legis lation Is uucessary, inasmuch as ample authority iu tho promises is conferred ou the Board ol Education mid the ward trustees, by section 12 ol tho staiulo law.
