The General Term of the Superior Court yesterday tendered ? number of doclsiona on appeals argued during the lalt term. Among others ol importance was one la the suit ol Rose McDonald, who, as ad ministratrix of bor husband, brought a suit acainst Cbarlea H. Mallorv and others, ownors of the ill-fated City ol Waco. Tho plaintiff, In her complaint, slates that iba defendants, in violation of section 4,472 of the Unltod States Revised Statutes, loaded the steamer with 300 casos ol crudo petroleum. When the vessol reached tho Gulf of Mexico a Ore broko out, and, the petroleum finally becoming Ignited, tho vessel was completely destroyed and all on board, including her husband, wbo was employed as fireman, wore lost. Sbo charges that the fire wus the re sult ol dclcudaDts' uo^ligenco, and brought this suit to recover $10,000 damages. The deloudunts de murred to the complaint on the ground that sufficient facts wero not stated to constitute a cause ol ucnou, and the demurrer was sustained on tho ground that tho stntuio referred to had no operation on a vcsiol on tho high seas. From this Judgmont an appeal wus taken, and the General Tornt, Judge dougwtuk writiug tho opluion, alfirms the order ol tho Court bolow. It would sotm that tno plaintiff allowed employes of the delondunt, who were excavating tbo adjoining premises, to outor tbo Sun Building in order to eunblo thorn to obtain convenient access to the wall for tbo purpose of shoring it up and supporting it by proper Inundations.
