WHEREAS, an emergency exists for the immediate preser vation of the public peace, prop erty, health and safety and for the usual daily operation of a municipal department. NOW, THEREFORE, BE IT ORDAINED by the Commission of the City of East Cleveland, Ohio, four-fifths of all members elected thereto concurring. SECTION 1: That an annual license fee shall be issued by the City Manager for the operation of miniature skee ball bowling al leys, shuffle board, and shuffle alley (or shuffle skill) games within the corporate limits of the City of East Cleveland. Public miniature skee ball alleys shall be each approximately fourteen (14) feet long and four (4) feet wide, and the delivery of the balls on said alleys shall be by hand only and not by mechanical devices. Ail games herein specified shall at no time be operated in any way, man ner or form as a gambling device or as a game of chance. SECTION 2: The City Manager shall cause an investigation to bo made of the applicant for a license and of the premises wherein the games herein specified are to be operated. The City Manager shall have authority to approve or reject any application for a license. Said application shall be made and said license shall be issued upon forms furnished by the City of East Cleveland. SECTION 3: The City Manager shall have the power to revoke or suspend any license issued in ac cordance with this ordinance when ever in the operation of the games herein licensed, there has been a violation of any of the provi sions of this ordinance or any other ordinance passed in the further ance of the public health or safety: or if the games herein specified shall be operated in any way, man ner or form as a gambling device or as a game of chance or if any license has been transferred with out the consent of the City. In the event of -such revocation or suspension of said license, there shaU be no refund of the paid license fee for the unexpired term of said license. SECTION 4: For each license issued for any of the games here in specified, a fee of Fifteen Dol lars ($15.00) shall be paid by the applicant in advance for each calendar year ending on December 31st, except that the fee to be paid for the first license granted for each game shall be Seven Dol lars and Fifty Cents ($7.50) after July 1st. Each game shall require a separate license. The fee for the transfer of each licence to any applicant or place shall be Five Dollars ($5.00). No transfer of a license, either as to applicant or place, shall be permitted except with the consent of the City Man ager, which consent shall be en dorsed and signed upon the license, and provided further that the ap plicant applying for the transfer of any license, shall comply with all the provisions of this ordi nance the same as though he were the original applicant. All licenses hereinbefore provided shall be displayed in a conspicuous place where said games are played, SECTION 5: That Ordinance No, 4190, passed November 5, 1947, and entitled: “An Ordinance to regulate the operation, conduct and maintenance of public miniature skee ball bowling alleys and fixing an annual license fee for the oper ation thereof, and repealing Ordi nance No. 3998, passed November 20, 1945,” be and the same is here by repealed. SECTION 6: That this ordinance is hereby declared to be an emer gency measure necessary for the immediate preservation of the pub lic peace, property, health and safety and for the usual daily operation of a municipal depart ment, and provided it receives the affirmative vote of four-fifths of all members elected to the City Commission, it shall take effect and be in force from and after January 1, 1950 otherwise, it shall take effect and be in force from and after the earliest period allowed by law. No person, firm or corporation owning or having the possession, charge or management of any hotel, lodging house, restaurant, soda fountain, shop, office building, hospital, club, place of assembly, railway station, public waiting place, public conveyance, mar ket, playground, park or other public place shall provide or per mit to be used therein, thereon or thereabouts, any drinking utensil or eating utensil for com mon use. The term “common use” in this section shall be construed to mean use by any person after use by another per son of any such utensil without cleaning in such manner as to destroy pathogenic bacteria be fore each such use.” be and the same is hereby amended to read as follows: SECTION 307. STERILIZA TION OF UTENSILS AND CONTAINERS, (a) No person, firm, corporation, or association owning or having the possession, charge or management of any hotel, lodging house, restaurant, soda fountain, shop, office building, hospital, club, place of assembly, railway station, pub lic waiting place, public convey ance, public market, playground, park or other public place shall provide or permit to be used therein, thereon or thereabouts any drinking utensil or eating utensil, or other food container used for the preparation or storage of food, except single service sanitary paper units, unless each such utensil shall have been cleansed and sterilized in accordance with the following procedure, prior to such use. Such utensil shall first Be cleansed by scraping or rinsing adhering food particles there from and shall then be thor oughly washed with soap or a detergent and hot water at a temperature not less than 112 degrees Fahrenheit when washed by hand, and not less than 140 •degrees Fahrenheit when washed by machine, in either case the wash shall be followed by a sterilizing treatment according to either of the following pro cedures. PROCEDURE 1: All such uten sils shall be subjected to a clean water rinse at a temperature of not less than 170 degrees Fah renheit for a period of 30 sec onds. PROCEDURE 2. All such uten sils shall be subjected to a clean water rinse followed by immer sion for such period of time as the Director of Health shall prescribe in clean water con taining not less than one hun dred fifty (150) parts per mil lion of a bactericide approved for such sanitizing purpose, by him or a person designated for such purpose by him. (b) Whenever the person, firm, corporation or association in charge of the places specified in Section 307 (a) hereof shall pro vide proper equipment, hot water at the designated temperatures, or approved sterilizing agents, the person actually improperly washing such utensils or using such improperly washed utensils shall be charged under this sec tion. Whenever the person, firm, corporation or association in charge of the places specified in Section 307 (a) hereof shall fail to provide the facilities required to comply with said section or continues to employ a person convicted twice for violation of Section 307 (a) hereof in a capa city where such person washes or sterilizes or uses food hand ling utensils, such person, firm, corporation or association shall be charged under this section. SECTION 2: That this ordi nance is hereby declared to be an emergency measure necessary for the immediate presrvation of the public peace, property, health and safety and for the usual daily operation of a municipal depart ment, and provided it receives the affirmative vote of four-fifths of all members elected to the City Commission, it shall take effect and be in force from and after its passage otherwise, it shall take effect and be in force from and after the earliest period allowed by law. Steffens Cites Regulation For Public Yuletree As an added safety measure dur ing the holiday season when Christ mas trees, varied decoration* and candles are so extensively used to add to the joy and the beauty of the holy season, Fred A. Steffens, chief of the East Cleveland Fire Department, issues regulations for all such use in public places. Mr. Steffens urges everyone having any part in setting up such decor ating to follow the rules here set forth. In the first place the number of natural trees which may be dis played in public places is limited to one. It must be under the super vision or an inspecting officer from the department and be subject to the following rules: 1—Tree height must not exceed ten feet. 2—No tree will be permitted in lobbies, mezzanine floors, passage ways or near places of egress. 3— No electric lights or electri cal wiring will be permitted on or under such trees. Lighting shall be indirect. No peat moss or cotton shall be used and all decorating shall be as incombustible as possi ble. No candle or open flame shall be permitted on or near tree. 4—Artificial trees will be per mitted, under the supeiwision of the inspecting officer. Wreath’, streamers and other decorations to be used for decorative purpose shall be fireproof. By observing these precautions, under order of Chief Steffens, the danger of a fire or injury to person because of Christmas decorations, will be brought to a minimum.
