FIVE-DAY WEEK Asked in Grain Exchange Code Washington, D. C. (ILNS)—At hearing on a proposed code for grain exchange firms, President Frank B. Powers, of the Commercial Telegra pliers' Union of North America!, strenuously objected to reports made by members of the industry that un employment was slight and showed that 48 per cent of all telegraphers in the industry are unemployed. Mem bers of the industry, who claimed department of commerce figures as support, said employment was 99 per cent of 1929 figures. Definite classification of employes who would be exempted by the $35 per week provision was asked by Powers who said telegraphers were made to work extra hours, although not classified as executives. Repre sentatives of the industry said they were willing to have the exemption apply only to executives and persons in managerial or supervisory capacity and not to skilled employes receiv ing over $35 per week. Powers also asked that worker* be employed on a five-day week basis and unemployed telegraphers be em ployed on the sixth day. The code would set an average 40 hour week, 44 hours in emergency averaged over four months period without pay for overtime. Maximum hours would apply to guards and watchmen, outside salesmen, partners in any copartnership, employes in managerial capacity receiving over $35 per week. Wages would range from $1 to $16 per week. All time in excess of 44 hours would be paid at the rate of 133 1-3 per cent of regular rate. Wages would not be reduced if they were above the fixed minimum prior to signing of code. MOLDERS' UNIONS REPORTBIG GAINS Cincinnati, 0. (ILNS)—Four new local unions have been organized by the International Moklers' Union, headquarters here reports. The new unions are at Waterbury, Conn., Win ston-Salem, N. C., and two at East St. Louis, 111. Twenty-three new local unions have been formed since July 1 and hundreds of new members have joined old unions. The increase in membership in the past quarters has been the greatest for any quarters since June, 1923. The increase includes new members as well as old members reinstated. UNION SCORES IN MINE ELECTIONS Washington, D. C. (ILNS)—Big gains were scored by the United Mine Workers of America in the election in the "captive" coal mines of West ern Pensylvania, held under the di rection of the National Labor Board The results show that of 14,137 votes, 9,929 went to representatives of the United Mine Workers and 4,045 "company" union. Among all the mines voting, 2® gave majorities for the United Mine Workers and nine for the "independ ents," as the "company" union rep resentatives were designated'on the ballots. Senator Robert F. Wagner, chair man of the National Labor Board, warmly praised the miners' conduct at the election. "The gratifying thing in this indus trial election," he said, "was that it was peaceful and orderly. The miners of southwest Pennsylvania, carried through this election in model fashion on an economic issue that was far closer to them and had been more bitterly fought than are issues in many ordinary elections." GREEN INSISTS WORK WEEK BE CUT Washington, D. C. (ILNS)—Presi dent William Green, of the American Federation of Labor, strongly prot tested against the 40-hour week, 40 cents per hour minimum and other labor provisions of the Diesel engine code. Declaring that the code would serve as a standard for at least 40 other codes being sponsored by the Machinery and Allied Produts Insti tute, President Green said that con sideration of its terms presented a grave responsibility to the national recovery administration. The labor head insisted that the work week must be shortened in all industries and that in this particular case a 40-hour week would create no re-employment whatsoever as the Diesel engine industry has been work ing on that recently. ORDINANCE No. 3394 Providing for the issue of bonds of the City of Hamilton, Ohio, in the sum of $620,000 for the purpose of raising money to provide the necessary funds to pay the cost and expense of reconstructing, extending, enlarg ing. improving and repairing of the Water works of the City of Hamilton. Ohio, for supplying water to the corporation and the inhabitants thereof, and repealing Ordinance No. 3367, passed by Council of the City of Hamilton, Ohio, June 28, 1933. WHEREAS, It is desirable to participate in the federal work relief program, and to receive the benefit of grants from the federal gov ernment in accordance with the terms of the National Industrial Recovery Act," and to make it possible for the City of Hamilton to provide work for the unemployed and WHEREAS, By the provisions of said "Na tional Industrial Recovery Act" financial aid is offered by the government of the United States to municipalities for the making of grants not to cxceed 30 per cent of the cost of the labor and material employed upon municipal improvement projects, and by mak ing loans to such municipalities to pay the balance of the cost of such projects, under certain conditions, restrictions and agreements in said act contained or promulgated under the authority of and pursuant to the pro visions of said act and WHEREAS, The Council of the City of Hamilton, Ohio, has determined that the cost of reconstructing, extending, enlarging, im proving and repairing the waterworks of the City of Hamilton, Ohio, by the drilling of new supply wells, the construction of a new waterworks building and installing therein the necessary pumping and other equipment, the construction of a complete water softening plant, of a coagulation basin and of a new reservoir, and the construction of new force mains and new distribution mains in the existing distribution system, both within and without the corporate limits of the City, and all for supplying water to the City and the inhabitants thereof, in excess of the 30'/' grant from Federal Government be raised by the issuance of bonds and WHEREAS, The Council has requested the Director of Finance to issue his certificate as to the estimated life of the property, assets or improvement proposed to be acquired „r constructed, and the proceeds of the bonds hereinafter referred to, and the Director of Finance has certified to this Council such estimated life as exceeding five years and has further certified the maximum maturity of such bonds as 40 years. NOW. THEREFORE, BE IT ORDAINED by the Council of the City of Hamilton, Ohio, two-thirds of all members elected thereto concurring! SECTION 1. It is hereby deemed neces sary by the Council of the City of Hamilton, Ohio, to issue and sell bonds of said City in the sum of $620,000 for the purpose of raising money to provide the necessary funds to pay the cost and expense of reconstructing, extending, enlarging, improving and repairing of the waterworks of the City of Hamilton, Ohio, by the drilling of new supply wells, the construction of a new waterworks building and installing therein the necessary pumping and other equipment, the construction of a complete water softening plant, of a coagula tion basin and of a new reservoir, and the construction of new force mains and new dis tribution mains in the existing distribution system, both within and without the cor porate limits of the City, and all for supply ing water to the City and the inhabitants thereof, in excess of such grant as may be made to the City of Hamilton, Ohio, under the provisions of the ''National Industrial Recovery Act" and also for the purpose of providing a fund to pay the interest accru ing on said bonds previous to the receipt of taxes from which such interest is to be ulti mutely paid. SECTION II: It is hereby determined to proceed with the issue of said bonds in one lot and without issuing notes in anticipation of the issue of said bonds. SECTION III: That serial bonds of the City of Hamilton shall be issued in the sum of $620,000, which amount includes the sum for interest maturing on said bonds previous to the receipt of taxes from which such in terest is to be ultimately paid for the pur pose aforesaid. Each of said bends shall be dated January 1, 1934, and shall bear inter est at the rate of four per cent, payable semi-annually on the first day of April and October of each year until the principal sum is paid. That said bonds shall mature as follows: 20 bonds in denomination of $1,000 each on October 1st of each of the years from 1985 to 1944, both inclusive, and 21 bonds in the denomination of $1,000 each on October' lit of cach of the years ,'rom 1946 to 1964, both inclusive, which maturities are hereby determined to be in substantially equal annual installments. The principal and interest of said bonds shall be payable at the office of the Treasurer of the City of Hamilton, Ohio, or at such place as may be designated by the United States of America, or the proper instrumentality thereof, the purchaser of said bonds. Said serial bonds shall bear such con secutive numlers as the Director of Finance, or the proper officer of the City, shall de termine, and shall be sold to the Federal Emergency Administration of Public Works of the United States of America without offering to competitive bidding, in the event the Sinking Fund Trustees refuse to take the same, but in all other respects shall be iRsued. executed and disposed of in accordance with the general laws of the State of Ohio, par ticularly the uniform bond act of the General Code of Ohio. SECTION IV: Said bends shall express upon their face the purpose for which they are issued, that tney are issued in pursuance of this ordinance, and shall be signed by the City Manager and the Director of Finance, and sealed with the corporate seal of said City. The interest coupons attached to said bonds shall bear the facsimile signature of the Director of Finance. SECTION V: The proceeds from the sale of said bonds, except the sum included in the amount of the issues to the extent necessary to provide a fund for the payment of the interest accruing on said bonds previous to the receipt of taxes from which such interest is to be ultimately paid, and the premium and accrued interest thereon, shall be credited to the funds for the purpose of paying the cost and expense of the impro%'ement as set forth in Section I of this ordinance, and for no other purpose, and shall be disbursed upon proper vouchers for the purpose aforesaid, for which purpose said money is hereby appro priated. SECTION VI: For the purpose of providing the necessary funds to pay the interest on the foregoing issue of bonds promptly when and as the same fall due, and also to provide^ a fund sufficient to discharge the said serial bonds at maturity, there shall be and is hereby levied upon all of the taxable prop erty of the City of Hamilton, Ohio, a direct tax annually during the period of the time such bonds are to run, in an amount suffi cient to provide funds to pay the interest upon said bonds as and when the same falls due, and also to provide a fund for the dis charge of the principal of said serial bonds at maturity, which taxes shall not be less than the interest and sinking fund tax re quired by Section II, Article XII, of the Con stitution of Ohio. Said tax shall be and is hereby ordered computed and certified, levied and extended upon the tax duplicate, col lected by the same officials in the same man ner and at the same time the taxes for general purposes for each of said years are certified extended and collected. Said tax shall be placed before and in preference to all items and for the full amount thereof. The funds derived from said tax levy hereby required shall be placed in a separate and distinct fund which together with the interest col lected on the same shall be irrevocably pledged for the payment of principal and interest on said bonds when and as the same fall due. Provided, however, that in each year that surplus earnings of the waterworks system are applicable to the payment of such inter est and principal and are appropriated for uch purpose, the amount of such tax shall be reduced by the amount of such surplus earnings so appropriated. SECTION VII: Ordinance No. 3367, passed by Council on June 28, 1933, be and the same is hereby repealed. SECTION VIII: The Clerk of Council is hereby directed to forward a certified copy of this ordinance to the County Auditor. Dec. 8-lt EMERGENCY ORDINANCE No. 3395 Providing for the issue of bonds of the City of Hamilton, Ohio, in the sum of $425,000 for the purpose of raising money to provide the necessary funds to pay the cost and expense of acquiring real estate for a new Municipal City Hall Building, to erect a Hew Municipal City Hall Building to be used for all municipal purposes and to fur nish and equip the same, and repealing Ordinance No. 3364, passed by Council of the City of Hamilton, Ohio, on June 28, 1933. WHEREAS, The subject matter contained herein constitutes an emergency in that it provides for the immediate preservation of the public peace, property, health and safety of the citizens of Hamilton the reason for said emergency is the immediate necessity to pro vide funds to enable the City of Hamilton to participate in the federal work relief pro gram, and to receive the benefits of grants from the federal government in accordance with the terms of the "National Industrial Recovery Act" and to make it possible for the City of Hamilton to provide work for the unemployed, it is necessary that thiB legislation go into immediate effect and WHEREAS, It is deemed expedient and for the public good to purchase additional ground for a site for a new Municipal City Hall Building, and to construct, equip and fur nish a new Municipal City Hall Building in the City of Hamiltton, Ohio and WHEREAS, By the provisions of said "Na tional Industrial Recovery Act" financial aid is offered by the government of the United States to municipalities for the making of grants not to exceed 30 per cent of the cost the labor and material employed upon municipal improvement projects, and by making loans to such municipalities to pay the balance of the cost of such projects, un der certain conditions, restrictions and agree ments in said act contained or promulgated under the authority of and pursuant to the provisions of said act: and WHEREAS. The Council of the City of Hamilton, Ohio, has determined that the cost of acquiring additional real estate to be used is a site for the new Municipal City Hall Building will be approximately $120,000 that the cost of erecting said building, exclusive of any grant from the federal government, will be $277,000, and that th" cost of fur nishing and equipping the same, exclu sive of any grant from the federal govern ment, will be $28,000 and WHEREAS. The Council has requested the Director of Finance to issue his certificate as to the estimated life of the property assets or improvement proposed to be acquir ed or constructed, and the proceeds of the bonds hereinafter referred to, and the Direc tor of Finance has certified to this Council such estimated life as exceeding five years and has further certified the maximum ma turity of such bonds as determined by the weighted average as 25 years. NOW, THEREFORE. BE IT ORDAINED by the Council of the City of Hamilton, Ohio, two-thirds of all members elected thereto con curring SECTION I: It is hereby deemed necessary by the Council of the City of Hamilton, Ohio, to issue and sell bonds of said City in the sum of $425,000 for the purpose of raising money to provide the necessary funds to pay the cost and expense of acquiring real estate for a new Municipal City Hall Building, to erect a new Municipal City Hall Building to be used for all municipal purposes, and to furnish and equip the same, in excess of uch grant as may be made to the City of Hamilton. Ohio, under the provisions of the 'National Industrial Recovery Act" and also for the purpose of providing a fund to pay the interest accruing on said bonds previous to the receipt of taxes from which such interest is to be ultimately paid. SECTION II: It is hereby determined to proceed with the issue of said bonds in one lot and without issuing notes in anticipation of the issue of said bonds. SECTION III: That serial bonds of the City of Hamilton, Ohio, shall be issued in the sum of $425,000, which amount includes the sum for interest maturing on said bonds previous to the receipt of taxes from which such interest is to be ultimately paid for the purpose aforesaid. That said bonds shall mature as follows: 17 bonds in denomination of $1,000 each on October 1st of each year from 1935 to 1959, both inclusive, which maturities are hereby determined to be in substantially equal annual installments. The principal and interest of said bonds shall be payable at the office ol' the Treasurer of the City of Hanylton, Ohio or at such place as may be designated by the United States of America, or the proper in strumentality thereof, the purchaser of said bonds. SECTION v: The proceeds from the sale of said bonds, except the sum included in the amount of the issues to the extent necessary to provide a fund for the payment of the interest accruing on said bonds previous to the receipt ol taxes from which such interest is to be ultimately paid, and the premium and accrued interest thereon, shall be cred ited to the funds for the purpose of paying the cost and expense of the improvement as set forth in Section I of this ordinance, and for no other purpose, and shall be disbursed upon proper vouchers for the purpoee of THE BUTLER COUNTY PRESS paying the cost and expense of acquiring real estate for a new Municipal City Hall Build ing, erecting a new Municipal City HhII Building, and furnishing and equipping the same, for which purpose said money is hereby lppropriated. SECTION VI: For the purpose of provid ing the necessary funds to pay the interest on the foregoing issue of bonds promptly when nd as the same fall due, and also to provide fund sufficient to discharge the said serial bonds at maturity, there shall be and is hereby levied upon all of the taxable property of the City of Hamilton, Ohio, a direct tax nminlly during the period of the time such lxndB are to run, in an amount sufficient to provide funds to pay the interest upon said bonds as and when the same falls due and also to provide a fund for the discharge of the principal of said serial bonds at maturity, which taxes shall not be less than the interest and sinking fund tax required by Section II. Article XII of the Constitution of Ohio. Said tax shall be and is hereby ordered computed nd certified, levied and extended upon the tux duplicate, collected by the same officials n the same manner and at the same time as the taxes for general purposes for each of said years are certified, extended and col lected. Said tax shall be placet! before and in preference to all items and for the full mount thereof. The funds derived from said tax levy hereby required shall be placed in separate and distinct fund which together with the interest collected on same shall be rrevocably pledged for the payment of prin pal and interest on said bonds when and as the same fall due. SECTION VII: Ordinance No. 3864, passed by Council of the City of Hamilton, Ohio, on June 28, 1938, be and the same is hereby repealed. SECTION VIII: The Clerk of Council is hereby directed to forward a certified copy of this ordinance to the County Auditor. Dee. 8-lt EMERGENCY ORDINANCE No. 3396 Authorizing and directing the City Manager to purchase additional ground adjoining the present site of the City Hall now owned by the City of Hamilton, Ohio, to be used as a site for a new Municipal City Hall Building, snd repealing Ordinance No. 3365, passed by Council of the City of Hamilton. Ohio, on June 8, 1933. WHEREAS, The subject matter contained herein constitutes an emergency in that it provides for the immediate preservation of the public peace, property, health and safety the citizens of Hamilton, Ohio, and that in order to permit the subdivision to partici pate in the federal work relief program and to receive the benefit of grants from the fed ral government so as to make it possible for the subdivision to provide work for the unemployed, it is necessary that this legis lation go into immediate effect and WHEREAS, By the provisions of the "Na tional Industrial Recovery Act" financial aid is offered by the government of the United States to municipalities and WHEREAS. The Council of the City of Hamilton, Ohio, deemes it expedient and for the public good to construct a municipal office building and WHEREAS, The Council of the City of Hamilton, Ohio, in deeming it expedient and to the public good to construct a municipal office building find it necessary to acquire by purchase additional ground adjoining the pres ent site of the City Hall now owned by the City of Hamilton. Ohio. NOW, THEREFORE. BE IT ORDAINED by the Council of the City of Hamilton. Ohio: SECTION I: That it is deemed expedient and for the public good to construct a new Municipal City Hall Building, and that it is hereby declared necessary to acquire by pur chase additional property adjoining the pres ent site of the City Hall for such purpose, to-wit: Tract 1. 19 feet taken evenly off the east, ide of Lot No. 250 as the same is known and designated on the list of lots in the Second Ward ol' the City of Hamilton, Butler County, Ohio. Tract 2. Part of Lots Nos. 249 and 250, as the same are known and designated upon the recorded plat of the City of Hamilton, Butler County. Ohio. Commencing at a point 19 feet westward from the southeast corner of said Lot No. 250 in the south boundary line there of, on the north side of High Street thence running westwardly on the south line of said lot and along High Street 19 feet thence at ight angles running northwardly on a line parallel with the east and west boundary lines of said lot 49 feet 11 inches to north bound ary line of said lot thence eastwardly along aid north boundary line 19 feet: and thence southwardly on a line parallel with the east and west boundary lines of said lot 49 feet 11 inches to the place of beginning. Said tax shall be and Is hereby ordered computed, certified, levied and extended upon the tax duplicate and collected by the same officials in the same manner and at the same time that taxes for general purposes of each of said years are certified, extended and col lected. Said tax shall be placed bet ore and in preference to all items and for full amount thereof. The funds derived from said tax levies hereby required shall be placed in a separate and distinct fund, which, together with the interest collected on the same, shall be irrevocably pledged for the payment of principal and interest on said bonds when and as the same fall due.
