V RESOLUTION NO. 7760 Declaring' the Intention to vacate tbe al ley running- east and west between Laurel Avenue and Weller Avenue, in the Sixth Ward of the City of Hamil ton, Ohio, and running from the west line of Zimmerman Avenue to a point IS feet east of the southwest corner of Lot 10422. BE IT RESOLVED by the Council of the City of Hamilton, Ohio: SECTION I: That Council does hereby declare its intention to vacate the fol lowing described alley ill the Sixth Ward of the City of Hamilton, Butler County, Ohio, and being more particularly de scribed as follows: the alley running east and west between Laurel Avenue and Weller Avenue, and running from the west line of Zimmerman Avenue to a point 1.') feet east of the southwest corner of Lot 10422. SECTION II: That the Director of Fi nance shall cause notice of said reso lution to be served in the manner pro vided by Section 120 of the charter of the City of Hamilton, Ohio, upon all persons whoso property abuts upon the streets and alleys affected by the proposed va cation, that a hearing be had before the Board of Revision of Assessments of the City of Hamilton, Ohio, on October 20, 1941, at 10 o'clock A. M., as provided by the charter of the City of Hamilton, Ohio. SECTION III: This resolution shall take effect and be in full force and ef fect from and after the earliest period allowed by the charter of the City of Hamilton, Ohio. Passed: September 17, 1941. Sept. 26—It RESOLUTION NO. 7762 A resolution erranting' to Kranth 8c Ben nlnghofen, of Hamilton, Ohio, a part nership, permission to construct a new sidetrack on Zimmerman Avenue, from the first alley running' east and west, north of Symmes Avenue, southwardly on Zimmerman Avenue approximately 260 feet, under certain terms and con ditions. W1110 HE AS, Krauth & Benninghofen have asked Council for permission to con struct and maintain a new sidetrack over, upon and across Zimmerman Avenue, from the first alley running east and west, north of Synunes Avenue, south wardly on Zimmerman Avenue approx imately 260 feet, in the Sixth Ward of the City of Hamilton, Ohio, which side track will serve the property of Krauth K- Benninghofen and will connect with the main line of The Baltimore & Ohio Railroad Company. THEREFORE BE IT RESOLVED by the Council of the City of Hamilton, Ohio: SECTION I: That permission Is hereby given to Krauth & Benninghofen, a part nership, of Hamilton, Ohio, comprising Eleanor C. Diesbach, Paul Benninghofen, Margaret Werner, and The First National Bank & Trust Company, of Hamilton, Ohio, Trustee under the terms of the last will and testament of Christian Benning hofen, deceased, to construct and main tain a new sidetrack over, upon and across Zimmerman Avenue, from the first alley running east and west, north of Symmes Avenue, southwardly on Zim merman Avenue approximately 260 feet, in the Sixth Ward of the City of Ham ilton, Ohio, all as shown upon the plat attached to their petition now on file with Council, which sidetrack will serve the property of Krauth & Benninghofen and will connect with the main line of The Baltimore & Ohio Railroad Com pany, said sidetrack to replace the side track now existing therein. SECTION II: That the authority, right and permission hereby granted is subject to the following terms, restrictions and conditions: (a) That the existing sidetrack over, upon and across Zimmerman Avenue, which now serves the property of Krauth & Benninghofen and which connects with the main line of The Baltimore & Ohio Railroad Company, shall be removed by said Krauth & Benninghofen. (b) Said sidetrack shall be constructed and laid in conformity to the existing grade of said street. (c) Said Krauth & Benninghofen shall repave the street where said sidetracks are removed at its sole cost and expense, and shall repave at its sole cost and ex pense said street where said new side* track is placed, all subject to the direc tion and approval of the Director of Public Works of the City of Hamilton, Ohio. (d) That said sidetrack shall be con structed under the supervision and to the satisfaction of the Director of Pub lic Works of the City of Hamilton, Ohio. fe That said Krauth & Benninghofen shall at all times keep said street be tween the rails of said track in good order and repair. (f) That Krauth & Benninghofen shall indemnify and save harmless the City of Hamilton, Ohio, from and against all claims, demands, suits and liabilities of any kind that the city may be subjected to by reason of the prosecution of said work, or the construction, maintenance and use of said sidetrack. SECTION III: This resolution shall take effect and be in full force and ef fect from and after the earliest period allowed by the charter of the City of Hamilton, Ohio. Passed: September 17. 1941. Sept.. 26—It ORDINANCE NO. 4182 Authorizing1 and directing the Director of Law to settle the suit of Elizabeth Mc Closkey against the City of Hamilton, Ohio, being" cause Number 51730 in the Common Pleas Court, Butler County, Ohio, and the claim of Mrs. Sam Willsey. WHEREAS, Elizabeth McCloskey has filed suit against the City of Hamilton, Ohio, in the Common Pleas Court of But ler County. Ohio, being cause Number 51730, on aecount of injuries sustained by her, all as set forth in said petition and WHEREAS, Mrs. Sam Willsey has filed a claim against the city for injuries received by her when she stepped into a cut made in the sidewalk on North Ninth Street, and tripped and fell and WHEREAS, the said Elizabeth Mc Closkey and Mrs. Sam Willsey have of fered to settle their claims. THEREFORE BE IT ORDAINED by the Council of the City of Hamilton, Ohio: SECTION I: That the Director of Law be and he is hereby authorized and di rected to settle the suit of Elizabeth Mc Closkey against the City of Hamilton, Ohio, now pending in the Common Pleas Court of Butler County, Ohio, and being cause Number 51730, for the sum of Four Hundred Dollars ($400.00) and also the claim of Mrs. Sam Willsey for the sum of Fifty Dollars ($50.00) and that said sums are hereby ordered and directed to be paid in full settlement thereof. SECTION II: That the Director of Fi nance is hereby authorized and directed to issue his warrants in payment thereof from Contingent Fund, Item 110. SECTION III: This ordinance shall take effect and be in full force and ef fect from and after the earliest period allowed by the charter of the City of Hamilton, Ohio. Passed: September 17, 1941. Sept. 26—It O&DXNANOB NO. 4183 An ordinance granting* to the United States of America the right and ease ment to lay, construct, operate and maintain a sanitary sewer in the Fifth Ward of the City of Hamilton, Ohio, under certain terms and conditions. WHEREAS, tile United States of America has asked Council for a grant of right of way and easement to lay, construct, operate and maintain a san f»v.ir itary sewer through and across the route described in Section 1 of this ordinance the same to connect with the existing sanitary sewers of said city. THEREFORE BE IT ORDAINED by the Council of the City of Hamilton, Ohio: SECTION I: That the City of Hamil ton, Ohio, does hereby grant unto the United States of America the right and easement to lay, construct, operate and maintain a sanitary sewer in ttie Fifth Ward of the City of Hamilton, Ohio, through and across the following de scribed real estate: Beginning at a point in Bender Avenue at the west line of Mo.sler Avenue, as it was originally platted and thence west on Bender Ave nue approximately 720 feet to the east boundary line of Erie Highway, and from the west boundary line of Erie Highway westwardly approximately 20 feet and to connect said sanitary sewer to the existing city sanitary sewer on Sipple Avenue. SECTION II: That the authority, right and permission hereby granted is subject to the following terms, restrictions and conditions: (a) The laying and constructing of said sewers shall be subject to the di rection and approval of the Director of Public Works of the City of Hamilton, Ohio. ORDINANCE NO. 4184 An ordinance to correct special assess ments heretofore levied for the Im provement of Race Street, from Second Street to Third Street, in the City of Hamilton, Ohio, by constructing san itary sewers, house connections, man holes, lamp holes, Hush tanks, etc., where necessary, by rebating portions of said assessment levied t.o pay the cost and expense of such improvement, and amending Section IX of Ordinance Number 4049. WHEREAS, a special assessment was levied under Ordinance No. 4049 for the purpose of paying the cost and expense of the above improvement and WHEREAS, upon completion of such improvement it appears that the total cost was less than the amount assessed and WHEREAS, the Director of Finance has certified to the Council a corrected and which lots and lands are hereby de termined to be specially benefited by said improvement. y SECTION II: That Section II of Or dinance No. 4049 shall be amended to read as follows: "That the owners of the several lots and parcels of land included in this as sessment shall pay the amounts from them as severally due, as shown by this assessment, to the City Treasurer within thirty days from and after the passage of this ordinance, and in default thereof said tax with interest at not to exceed six per cent per annum, payable annu ally in advance on deferred payments, shall be payable to the County Treasurer in ten annual installments with the reg ular tax of 1 !i-IU, 194:!. 1944, 1945, 1946. ORDINANCE NO. 4185 An ordinance to correct special assess ments heretofore levied for the im provement of Ridgelawn Avenue Alley, from Webster Avenue to Cereal Ave nue, in the First Ward of the City of Hamilton, Ohio, by grading and paving the roadway thereof with a permanent material such as concrete, brick, as phalt, asphaltic concrete, Warrenite bitulithic, or any other type of ma terial as may be determined by re bating' portions of said assessment levied to pay the cost and expense of such improvement, and amending" Sec tion II of Ordinance Number 4062. WHEREAS, a special assessment was levied under Ordinance Nn. 40t!2 for the purpose of paying the cost and expense of the above improvement and WHEREAS, upon completion of such improvement it appears that the total cost was less than the amount assessed and WHEREAS, the Director of Finance has certified to the Council a corrected Owner Albert and Florence Burkey Julius arid L. WHEREAS, the Board of Revision of Assessments has reported to this Council the necessity for this improvement and recommended the assessment report filed with Council by the Director of Finance after due consideration and public hear ing and WHEREAS, the Director of Public Works being directed by the City Man ager has fixed ten years as the estimated life of this improvement. NOW THEREFORE BE IT OR DAINED by the Council of the City of Hamilton, Ohio: SECTION 1: That it is hereby deter mined to proceed with the Improvement of Millikin Street, from Street to Mc Kinlev Avenue, in the First Ward of the City of Hamilton, Ohio, by constructing sidewalks, curb and gutter on both sides of said street where necessary, and grad ing and gravelling the roadway thereof where necessary, and constructing san itarv sewers, house connections, man holes, lamp holes, flush tanks, etc., where necessary, pursuant to Resolution No. 7748 adopted by the Council on July 16, 1941. and for the purpose of paying the cost and expense thereof there is hereby levied a special tax upon the several lots and parcels of land designated in and in accordance with the estimated assessment prepared by the Director of Finance, as made for that purpose, on file with Council and recommended to Council by the Board of Revision of As sessments on the 10th day of September, 1941, which was made on the basis of the foot frontage upon the following de scribed lots and lands, to-wit: all lots and lands bounding and abutting upon the proposed improvement, which lots and lands are hereby determined to be specially benefited by said improvement. Sept. 26—It ORDINANCE NO. 4190 To borrow money by issuing note or notes in anticipation of the issuance of bonds to be issued in anticipation of the collection of special assessments to pay the cost and expense of im proving Millikin Street, from Street to McKinley Avenue, in the Pirst Ward of the City of Hamilton, Ohio, by con structing sidewalks, curb and gutter on both sides of said street where nec essary, and grading and gravelling the roadway thereof where necessary, and constructing sanitary sewers, house connections, manholes, lamp holes, flush tanks, etc., where necessary. BE IT ORDA1N El by the 'uuiK^TTT.i' the City of Hamilton, Ohio: SECTION I: That it is deemed neces sary to borrow money in anticipation of the issuance of bonds to be issued in anticipation of the collection of special assessments to pay the cost and expense of Improving Millikin Street, from Street to McKinley Avenue, in the First Ward of the City of Hamilton, Ohio, by constructing sidewalks, curb and gutter on both sides of said street where nec essary, and grading and gravelling the roadway thereof where necessary, and constructing sanitary sewers, house con nections, manholes, lamp holes, flush tanks, etc., where necessary, as provided in Section 2293-24 of the General Code of Ohio, in the sum of $5,791.51, the esti mated amount of said assessment. SECTION II: That the City Manager and the Director of Finance of the City of Hamilton, Ohio, shall issue note or notes for the above amount. Said note or notes shall bear interest at the rate not to exceed six per cent per annum, and shall be dated as of date of the issu ance, and said note or notes shall be due and payable on or before two years from the date thereof. Said note or notes ,,v.-n,^--*** shall express upon their face the purpose for which they were issued, that they were issued in pursuance of this ordi nance and in accordance with Section 2293-24 of the General Code of Ohio, and shall be signed by the City Manager and the Director of Finance of Hamilton, Ohio, and sealed with the corporate seal of said city. SECTION III: That the faith, revenue and credit of the City of Hamilton, Ohio, are pledged to the prompt payment of said notes hereinabove described in ac cordance with the laws and constitution of the State of Ohio. In the event that assessments are not levied or bonds are not issued to provide a fund for the pay ment of such notes at maturity, there shall be and is hereby levied upon all of the taxable property of the City of Ham ilton, Ohio, in addition to all other taxes a direct annual tax sufficient to pay the interest and to create a sinking fund to redeem at maturity the above provided for notes, which tax shall not be less than the interest and sinking fund tax required by Section 11 of Article 12 of the Constitution. Provided, however, that in each year that the assessments anticipated by said notes are payable and are applicable to the payment of such interest and principal and are appropri ated for such purpose, the amount of such tax shall be reduced by the amount of the assessment so appropriated. The amount of said tax to be computed by the taxing authorities and to be certified to the proper officers, and the same shall be levied and collected as other taxes are levied and collected. Said tax shall be placed before and in preference to all other items and for the full amount thereof, and all funds derived from said levies hereby required shall be placed in a separate and distinct fund, which to gether with all interest collected on the same shall be irrevocably pledged for the payment of the interest and principal of said notes when and as the same fall due. SECTION IV: That the proceeds aris ing from the sale of said notes shall be placed to the credit of the fund for the payment of said improvement and all un expended balances remaining in said fund after the cost and expense of the improvement have been paid and the pro ceeds of all bonds sold in anticipation of the collection of deferred installments of assessments and all cash payments of assessments shall be applied to the pay ment of said note or notes and interest thereon until both are fully provided for. SECTION V: That the Director of Fi nance be and he is hereby authorized to issue his warrant to the Treasurer in payment for the cost of said improve ment. SECTION VI: This ordinance shall take effect and be in full force and ef fect from and after the earliest period allowed by the charter of the City of Hamilton, Ohio. Passed: September 17, 1941.
