WHEREAS, the Council of the City of Hamilton. Ohio, desires to abate the pol lution ol' the Ireat Miami River and to protect riparian rights in said river and WHEREAS, it is necessary to con struct sanitary trunk sewers and sewage disposal and treatment works in order to abate such pollution and WHEREAS, the sum of $2,131,700.00 will be required for such improvement, for which 25 year bonds are authorized. NOW THEREFORE BE IT RESOLV ED by the Council of the City of Hamil ton, Ohio: SECTION I: That it is hereby deter mined bv the Council of the City of Hamilton, Ohio, that it is necessary to issue the bonds of said city in an amount which this Council estimates as $2,131, 700.00, for the purpose of paying the cost and expense of constructing sani tary relief, trunk, main and intercept ing sewers, pumping stations, sewage disposal and treatment works and all structures incidental thereto, and the expense of tests, preparation of plans and specifications incidental to the prosecution of such sewage program tor improving and developing the sewage system of the City of Hamilton. Ohio, and the cost of condemning or purchas ing the lands, easements or rights of wav neeessary therefor, and paying damages incidental thereto, and to fur nish and equip the sewage disposal and treatment works and structures inciden tal thereto and that the funds at the disposal of this Council, including taxes that may be lawfully levied, and bonds that may lie lawfully issued without a vote of the people, are wholly insuffic ient for such purpose: that Council de clares the necessity of a bond issue tor purpose In the sum of $2,131,700.00 by a vote of the people and the levy of a tax outside of the limitations impos ed by Article 12, Section 2, of the Con stitution of Ohio, to pay the interest on and to retire said bonds, the proposed bonds to be dated approximately March 1, 1946, and to mature in 25 equal, or substantially equal annual installments following their authorization, and to bear interest at the rate now estimated at, and in 110 event to exceed four per cent per annum, payable semi-annually. SECTION II: That the question of the issuance of said bonds and the levying of such tax shall be submitted to the election of the City of Hamilton, Ohio at the next November election to be held at the usual voting places within said city, on the f.th day of November, 1945. SECTION 111: That the City Clerk be and she is hereby directed to certify a copy of this resolution to the County Auditor of Butler County, Ohio, for his calculation of the average annual tax levy required throughout the life of the bonds to pay the interest on and to re tire such bonds, assuming that they are all issued in one series, and that the amount of the tax list of the City of Hamilton remains the same throughout the life of said bonds, which certifica tions shall be made not less than sixty days prior to such November election. City RESOLUTION No. 7934 Declaring it necessary to improve Bond Avenue, from Dayton Street to Oil more Avenue, in the Third Ward of the City of Hamilton, Ohio, by construct ing Curb and Gutter and Grading and Gravelling the Street where necessary WHEREAS, the owners of more than sixty per cent of the foot frontage of Bond Avenue, from Dayton Street to Oilmore Avenue, have petitioned in writ ing fr.r the improvement of said street between the points named by construct ing curb and gutter and grading and gravelling the street where necessary, and that the entire cost of the improve ment, including City's portion of the cost, such as advertising, engineering, inspection, stakes, etc., be assessed by the foot frontage upon the lots and lands bounding and abutting upon said Bond Avenue, from Dayton Street to Oilmore Avenue.
