A few dsya since we announced the determination by the Saprsme Court of the United States of the great case of the State of Texs3 vs. George "W. White, et al. This cause was important by rea eon of the very grave questions of State Involved. "We have not before us the opinion of the Court, and therefore can give no satisfactory synopsis of all that was really decided. One point of vital Interest, however, to the country was ruled on tho side cf Republican liberty. That was, that no State of the Union ceapo-i to be & State by re&scn of the re elsUnce of her people or authorities to the Federal Govenment, but that each State on tho downfall of the reballion, or the close of the civil war, remained an Integral and corporate State, unshorn cf any of Its power?, and that its people Btill continued citizens of the Uclted States, co-equal in rights with thois of any other 8tate. "When the action of Congress' since the termination of tbe late civil war, so entirely adverts to this view of tho matter, is considered, this decision is full of hope for tho South and her people. Thus is judieialiy deliv ered by tbe highest Court in tho Union, the precise idsa as to the political condition of tbe seceding States on the eurrender of their srmleB. which was the basis of tho famous arti cles of capitulation, or oonoordat between Gen. JJohnson, of the Confedera'e, and Gsn. Sherman, of the Federal army. We always regarded tho modification of those articles by the authorities at Wash ington, and their refusal at once to ap prove, as the most unfortunate piece of rcd-tapeism that ever befel a country. It was, in fact, a groat and grave blunder. From it have fljwed a thousand ills, which otherwise would have been aver ted. It has made hate in one section ad discontent in another, vital for almost a generation. From this caus9 the wounds of civil war still bleed afresh, and tbe existing peace can scarcely be esld to be as yet more than merely a ces eation of Wir. Nor can it, in the nature of the case, be more until the Sjuthern peopie are ireeieu oinerwiae ma as a corquered and eurjtct population. This decision may perhaps reverse the policies or the i?ederai Government. One important consequence must flow from this decision, despite tho reconstruc tion laws. That is, that the citizens of the Southern States can not be punished bv military courts. We do not mean to say that even in a Territory mili tary law can bo applied to the citizen. It is too much to expect that even the Supreme Court of tho United States, composed, as It Is, mainly of Eidicais, would at onco rise to the highest judicial impartiality. Therefore, we do not ex pect to find In tbe opinion a fair render ing of all constitutional questions that parsed in discussion. But a large breach has been made by it in Radical legisla tion. This will widen under the pan derous blows already dealt, and which will continue to bs dealt by the Ameri can bar, In whom, as we once before ob served, is reposed to a largs extent the hopes of the country for a return to con stitutional methods. We have such con fidence in the professional pride of well trained and thoroughly educated lawyerc , that however low tbey may at times have' groveled in the miro of partisan politics, when they aaeeud the bench and atsumn the discharge of judicial functions, we believe that they will in deed become High Priests at the Altar of Justice, undergo a purification and hold the ermine high above the filth from which they may perhaps have emerged.
