Wil shire sud one Joseph Lenow, the last named of whom referred to never know ing that said pretended election was frau dulent and void, aud thereupon the said conspirators as complainants believo and charge to tie true without his knowledge, approbation or consent themselves, pre tended to cleat the said Robert 0. Wallace a director, to till the pretended vacancy of the said Lenow, and they aver that the said Robert C. Wallace w:to not present nor has he at any time been present with said conspirators in any of their nefarious transactionssincesaid pretended elections. Complainants further aver that said de fendants having thus fraudulently and corruptly pretended to constitute them selves Directors of said corporation in the further prosecution of their sail con spiracy, pretended to elect the said F. M. Mahan President of said railroad, and have since then pretended and no w pre tend and declare themselves to lie the le gally constituted President and Directors o! s ud corporation, and are demanding of said complainants to yield up to them their said offices and the possession of said railroad, ils archives, assets and property of every description, and have threatened and endeavored to take the same from complainants by fores and fraud, in pursuance of such purpose insti tuted first in Ihe Circuit Court of said c mnty ol Pulaski a proceeding in the na ture of a quo warranto against complain ants, and procured from the Hon. John McClure, Associate Justice of said Su preme Court, his hat as such for .111 in junction to be issued against complain ants without any notice to them ot any application therefor and without any equitable proceediugs therefor pending, a.id when complainants and their attor neys refused to obey the same because of its illegality aud after they had failed to procure lrom the honorable the judge of the Circuit Court, before w hom said order of injunction was made returnable an attachment for contempt, th procured the said Associate Justice to issue his fiat vacating his said previous order for said injunction, and so aban doned the same without instituting any equitable proceedings thereof, aud I here upon immediately procured from the said Associate Justice, without any no tice to the complainants, his fiat to tho Clerk of the said Supreme Court, direct ing him to issue an order of injunction against complainants, their attorneys, agents and employees, enjoining them from exercising or attempting to exer cise the offices of President aud Directors of said railroad company, or the rights or privileges belonging thereto, and from withholding from them tho possessit'ii of the pn perty and oitocts of said railrosd company, as will fully appear by a duly authenticated copy of said order of in junction here exhibited as exhibit C. Complainants further aver that they, their attorneys and employees, in like manner refused obedience to said last named 11 eg 1! order of injunction, where upon the said conspirators and defend ants, (except the said Robert C. Wallace), with or by md through persons by them thereto Instigated, attempted to take ios- beasion 01 saltl railroad aud the engine and rolling 3toek thereof, then at the de pot near said city of Little Rock by force, failing in which they, without serving them with any rule or notice to answer tor any ulleged contempt, procu red from the said John McClure a writ .if attach ment, by virtue of which Beverly D. Wil liams, the general agent and superintend ent of said road in the employ of com plainants and others of their employees, including engineers, were bv the .Sheriff of saiil county arrested and taken into custody, and taken away Inmi their sev eral posts of duty, which said arrests were, and as complainants believe and charge to be purposely so timed, as to keen them away from the train on said road at the hour at which it should start East, with the special purpose of seizing possession thereof by said conspirators. Complainants farther aver that to be re lieved from this illegal and oppressive ar rest, the said employees of complainants procured to be issued by the honorable, the judge of this court, writs of habeas corpus, and pending tho inquiry into the samo case of tho said Beverly D. Wil liams, they, the said defendants, except said Wallaee, procured one John R. Montgomery! Attorney-General for the said State, of Arkansas, and also the at torney of said conspirators, to institute in the Supremo Court of said State proceedings by writ of quo warranto, and calling upon complainants to answer thereiu before s;iid Supreme court ou the sixth day of December next.
