Bleckley, John Brown et a, came up for a hearing before Judge Anderson, of tbe Law court. Messrs. Smith, Randolph and Leo mppesred for Mr. Oreely; Meaani. Beerher, Sale, and County Attorney Wilson appeared for tbe Countv Court and Mr. John Brown I who was duly elected by the County Court, on Friday last, to nil tbe alleged vacancy caused by the resignation of Urely, as already detailed in tbe AprVALi. The petition ia for an alternative mandamus upon the members of tbe County Court compelling them to accept tbe bond ottered by Mr. Gr'ely, to administer to him the oath of otbee, and to induct him into tbe office of Register, or show cause why they should not do so. On final hearing the relator prays that a peremp tory mandamus be issued, etc The peti tion seta forth the fact that Mr. Oreely re signed bis office of Register of Shieibv countv on tbe 31th of March, 1870, by li intrhi rebiguation With the Clerk of the County Court; that on the 2Clh of March there was a general election held in Shel by county ; that he (Greely) was a candi date for the office of Register ot bhelby connty on said day, and received a ma jority of the votes cast for said office, and that he received, a certiiicaie of election from S. Shock, Commissioner, etc , and that the County Court refused to accept his bonds and induct bim into office, etc. The following tiat of Judge Anderson Appears indorsed on the petition: To tbe Clerk of the Uw Court ol M-ni- pMa: I'pou the relator, George M. Greely, executing bond, with security tor costs, you will issue an alternative mandamus to tbe defendants named in the foregoing petition, as justices of Shelby county, comniamiing them to induct said George M. Greely into tbe office of Register of Shelby county, or to appear before me iu court, sitting at the Law Court-room, on the Tib day of April, 1870, at 11 o'clock a.m.. and show oauao, if any they have, why they should not do so. J. A. ANDKRSOK, April A, 1S70. Judge, etc The defendants tiled an answer, deny ing that there was a vacancy lu the office on the liblb of March, 1870, bv which tbe relator could be elected. They charge fraud in the manner of Mr. Greely's elec tion: that in April, 1870, sometime after tbe election, tbe County Court acted upon the resignation of Mr. Greely, which had been tUed with the Clerk of the County Court : received and accepted tie same, and took proper steps to ui; said vacancy, as required by law. They charge, further, that the pretended election of Mr. Greely was a concocted scheme, en his part, to perpetuate hiniseii in ctfioe, and was null and void. They also demur ta ihr bill on tbe grounds of no equity in tbe aanie, sad further, that the I,aw Court had ta juris diction, etc. The answer of John Brown is also on file, alleging that he t Brown was elected by the County Court to till the vacancy caused by tbe resignation of Mr. Greely that he has given bond, etc.. and claim to be the Register of etbelby county. (The petition and answers are very vol uminous, going into the details of' the election with minuteness, and we there for only present above the main features of the bill apd answers). Mr. Wood, of Naw York, upon tbe Freed man'a Bureau, the most infamons of all tbe Radical creation: tUUtora Appeal: We would not do any one an injustice, but there are some things very strange in the management of tbe concern hereabouts. At thia agency bounties are paid to from oas to three colored soldiers per day some days none and to accomplish this enormous work the government keeps a Bureau agent and his two clerks here, pays tbe salaries, office rents, and what other expense we know not. After waiting three or four vests since filing their claims, these poor soldiers are compelled to make at feast two, aud often three and four, trips to this city, even after being notified by their claim agents that their claims have been allowed. To those living ISO or 200 miles distant, the expenses and loaa of time from tbe farm almost equal the amount of Ijouuty they receive. Last week we met a negro, a private of the Forty-second united states colored Infantry, who asked us how he could get bis tsmnly, stating that his money was at tbe Bureau agency here; that the agent wax satisfied wilhont any witnesses, two weeks ago, when be signed the vouchers to get tbe money from Washington to this agency, tnat ne was tne proper claimant; but that be could not now find witnesses who could satisfy said agent of his identity; that none of his company who have their discharge papers with them can be found abont here, and tbat the agent refused to pay on am- other kind of proof ; that be bad taken with him tbe most credible wit nesses, both white and colored, but could not get bis money. This, I believe, is tbe regular order of doing business there. ae ol these clerks administers oatba to affidavits, etc, and if they were net strictly honest, it would be a very easy matter in case of tbe death of a soldier, after hia money has come, to fix up tbe proof so as to show that the money bad been paid, and no one outside of that agency would be tbe wiser for It. We do not propose here to impeach the honesty of these men, but would suggest tbat ft is wrong lor any government to tbrow around its most honest and virtuous eiti xens any such temptations to specula tion and'peculation. We have for more than a year wondered why it was that neither attorneys nor any one else but tbe poor uneducated negro were al lowed to learn tbe status of soldiers' claims In other words, why were wean awered, "We do business with none but tbe claimants themselves," and we have wondered why tbe letters these poor fel lows would write to the Bureau at Wash ington, aaking tbe -i ; ot tbe delay, were not answered. We had almost sus pected that the clerks at Washington, nght under General Howard's nose, and tbe Bureau agents over tbe country had formed a "ring" or "corner" tor "bounty jumping" ana for lending money, which I am credibly informed has been' recently offered by a Bureau agent at the modest rate of fifty per cent, per annum. But now it seems some parttea in Washington charge that the pious old General Is a pu cillahimous cuss," that he is such a care ful guardian of the poor negroes' rights that be will not intrust them with their own money. County Court acted illegally and contrary to statutory law in electing air. Brown to tbe office of Register, citing several sections of tbe code with reference to their action in the premises. He con tended that there was a vacancy in tbe office of Register on the &tu of March, caused by the filing of resignation by Mr. lireely, and that the Commissioner of Registration acted according to law when he noticed tbe electors thst an election would be liclj for offices in Shelby county, and that Mr. Greely, rooeiving the high est number of votes oast for tbat office, was duly elected and entitled to be in ducted into office by the County Court. Provisions of the code and authorities were cited in support of these positions. Mr. Wilson reviewed the facts In tbe case at length, with reference to the resigultion of Mr. Greely, on the j i h of March, and bis alleged election on the MU t.. tbe office of Register. He commented on the fact that th ugh tu-j resignation of Mr. Greely wag addressed to tne Chairman of the County Court, and said Chairman T. C. Bleckley, was lit Ids office on said day ; yet this resignation re mained iu the office of Johu Eoague, County Conrt Clerk, without the knowl edge of the Chairman, to whom it was addressed. The vacancy was not known to tbe County Court or by the electors of Shelby county, except by bis (Greely's) friends, who voted for bim iGreely(. Mr. Wilson denied that lues facts aud siren Distances made a vacancy in tbe office of Register, and read sections of the Code with reference to vacancies and tbe manner of tilling tuein. At this point Judge AueWvon informed counsel that an adjournment of the argu ment would be had to this morning at 9 o'clock, at which time Mr. Wilson will conclude his argument, and will be followed by the other counsel retained m tbe ease. Tbe decision of the court, when ren dered, will be given In full, as it will no doubt embrace aud decide many Impor tant and novel questions with reference to elections iu Tennessee.
