The attention of the board of health is called to the cistern near the Theater. The cellar of the Theater is overflowed by seepage whenever the cistern is filled. This nuisance should be abolished. Bobert Nesbett, a farmer residing near Hernando, Mississippi, was arrested yesterday on trie cnarge of. forging an order on Hill, Fontaine & Co. It is said that he forged orders on other parties. Mr. Joshua Brown, jr.. of the firm of Brown, Nortou fc Read, has raturned from an extended business and pleasure visit east. We are glad to know that he ia in good health. Colonel Thomas H. Harris, broth er of Hon. Jame3 B. Harris, of Harde man county, died at his residence, near Bolivar, last week. Colonel Harris was one of the oldest settlers of Hardeman county, and a worthy citizen. Mr. F. G. Terry, an esteemed citi zen and prominent merchant, died yes terday. Mr. Terry bad been a citizen of Memphis for twenty-five years, and at tbe time of bis death was a member of the firm of Hill, Terry & Mitchell. Pettit, being called to the chair, stated that the object of the meet ins; was to appoint a committee to wait upon the general council and request tbat body not to interfere witn or abol ish (he botrd of health. Mr. Brown said tbat he did not think any such action would be entertained by the general council. Mr. S W. Green read tho ordinance as presented by Alderman M'CIoy, which uaa been referred to me ordinance com mittee, and which he thought would be reported on adversely by said committee to tne general council. President Pettit said that there was a good deal of feeling manifested on tbe subject among citizens, and he thought an expression of opinion was eminently rroper. THE PROTEST. Mr. J. T. Hillsman presented the fol lowing resolutions, which were adopted ana the chairman appointed as tne com mittee, Messrs. J. T Hillsman, M. L Meicbam and J. B. Godwyn: Jiesolvcd. That it is the sense of this mtetine, representing the business com munity of Memphis, that no change should be made in tne existing laws and ordinances governing tbe board of health, and tint tbe mayor and general council or the city are earnestly request ed not to change or modify the same as are at present in force. This board met in adjourned session, President Zsnt in the chair, and present Aldermen M'CIoy, Elder, G een, Dent. Cochran, Brown, Grant, Harvey atd Fleminp. The ordinance passed second and final reading by which tbe office of forceman of tbe street force and cbaln-gang is abolished. A petition to establish certain lamps, referred to city engineer with power to act by council, was amended, striking out "with power to act," and concurred in. Thomas W. The petition of John Johnson and others, praying the levy of a tax to pay certain bonds, etc., was relerred to the finance committee. Mrs. M. L. BrookB's petition to be al lowed to tafce about fifty cart-loads of dirt from Broadway, east of Raybum avenue, was granted. Mr. Steele's petition to have remitted a fine imposed by the recorder was laid upon the table, after a sharp debate as to itipropsr disposal. The petition in behalf of the Widow Mulverbill, allowing her to do business without license, was referred to the city attorney, in order to settle the question of right to grant such petitions. Alderman M'CIoy, from the special committee to Investigate Treasurer Kelly's books, reported having found his books correct, which report was re ceived and adopted, and tbe committee discharged. The report appears in full in the council's proceedings. The mayor's message in reference to the Bolton property on Hernando street extended, was referred to the mayor, with authority to settle tbe matter in volved. Deputy-Sheriff Rlchardet claimed the attention of the board with a stack of mandamus writs, service of which was duly acknowledged, and the municipal wheel gain began to revolve. The ordinance embracing the budget for 187G passed second and final-reading without amendments. The fire, hospital and city engineer's requisitions passed third reading. . The report of the finance committee on James Riley's account pasaed third reading. John Fisherjs account for writing up tax-books passed first reading. The report of the committee on ac counts was received and passed third reading, excepting tbe item of Charles Colllns's account. Pending this docu ment, Mayor Fllppin was called upon to affix his signature to the city budget, so as to legalize the appropriations pending. Mr. Mills's petition to be allowed to peddle pencils without license was re ferred to the maycr. On the report of the committeo ap pointed to sslect a suitab'e location for tbe office of the board of health and city dispensary, recommending the building on the southeast corner of Court and Second streets, etc., the board concurred with the council in the adoption of the report. Pending the discussion of this report Alderman Green wanted to substitute the word "dispeneatory" for "dispens ary." A universal smile extinguished the proposition, at.d distinguished the proposer. The ordinance specifying how certain fines may be remitted, etc., passed first reading, and was referred to the ordi nance committee. The resolution from the chamber of commerce and cotton exchange praying that no change be made in the laws governing the board of health was re ceived and filed. The resolution empowering ;the real estate committee to sell certain city property, etc., was amended so tbat , meir asiion snail do suomiuea to tne general council for ratification, and, as amended, the resolution was adopted. The petition of J. P. Meux for reduc tion of assessment wa laid on the ta ble. James Monegan's petition met with a similar fate. The communication of the Memphis gaslight company was rererred to tbe lights and lamps committee. A resolution was adopted tbat all p2- titions for reduction of assessments be referred to the special committees with out reading. The official bonds of City-Physician G. B. Thornton, and Sergeant-at-Arm3 A. R. Droescher, were received and ap pro ved. A mass oi business from the other board wai presented and its action con curred Id. A communication from tbe Memphis gaslight company, offering to supply the city with gas, lamps, etc, and signifying a readiness to again furnish gas. and at much cheaper rates than heretofore, pro vided arrangements ba made to pay for the same, was read. Tne communica tion was referred, by resolution of Coun cilman Donnovan, to the light and lamp committee to investigate the same, maKe arrangements lor a contract witn the pas company, and provide for tbe payment of debts due thereto. The resolution by the cotton exchange and chamber of commerce, reported elsewhere in to-day's Appeal, was re ceived. The budget passed Its final reading: also the requisitions of tbe city engineer, cmei or tho nro aepartmect and city hospital. The improvement committee's report was concurred in: also the netition of Schilling and others; tbat of Mrs. M. L. lirooks was non-concurred in, but re ferred to the improvement committee. Tho special committee recommended that the building on the southeast cor ner of Second and East Court streets be selected as the office for the board of health. The report was adopted. The audited accounts paised fiual reading. An ordinance vesting the recorder and chief of police with authority to remit fines imposed, passed first reading. A. petition ror reduction of assessment from J. P. Meux, was referred: that of John P. Fisher was granted. A communication was received Irom the mayor in reference to a letter fiom the city-attorney, concerning the Wash Bolton property. The matter1 was re ferred to tne committee on real estate. A resolution by Councilman Neeiy, that reauisitiona be accompanied with an estimated cost of supplies and an affidavit tbat tho same are necessary, was adopted. Deputy-Sheriff Richardet served the council with a mandamus issued by tbe supreme ccutt of Tennessee in the T.
