I | I j Out Of State Fishermen Win Right To Fish Here Four' Seattle fishermen were granted a preliminary injunction in their battle against a provision of the 1961 Alaska commercial fish ing regulation, by Superior Court Judge James A. von der Heydt. Judge von der Heydt ordered the State Department of Fish and Game to issue commercial set net licenses for the Kodiak district to Mondar Olsen, Aksel Kielhaber, Ray Arold and Clarence Peterson pending a legal decision in the case. The four men from Seattle brought suit against the depart ment after it refused to issue them Kodiak district set net licenses on the grounds that the 1961 regula tions specify that the holders of such licenses must have resided in the Kodiak district for one year prior to the start of fishing. The four men claimed the regu lation was unconstitutional in that it made a distinction not only be tween residents of Alaska and resi dents of other states, but also a distinction between residents of different areas of Alaska.
