Such a plea was published in the Toledo Blade, a daily newspaper and if the report is factual rather than a dubious account of the tax payer's petition and is taken or heard solely on its merits, its ap proval by the Civil Service com mission of Toledo would endanger the status of Alfred Stewart, the sole survivor of the declared illegal fire unit According to the city charter, any civil service eligible list expires after two years and anew list is established following competitive examinations. In the event that the present list Is declared invalid. Mr. Stewart would have to take another exam ination to qualify. If the real purpose of the suit Is to prevent any further appoint ments until the present eligible list expires, then Mr, Stewart is secure. However, John N. Edy, city manager has made no appointments from the present list to succeed the dismissed colored firemen and Indicated in no uncertain terms that to do so wasn't his intention. The only appointments made since No. 8 station was abolished as a colored fire unit, were for the express pur pose of filling vacancies created in other stations through death or re tirement. Mr. Edy exhausted every legal avenue to retain the colored men In their positions following affirma tion of a taxpayer's suit in the Common Pleas coifrt of Judge Scott Stahl. The case was reviewed by the district court of appeals and the Ohia supreme court liefore the mandate to dismiss the Negro fire men was issued. Mr. Meredith is being represented by the law firm of Christensen and Christensen, white. Mr. and Mrs. Jake Daniel, of Richmond, Va, were the week end guests of his brother, L. B. Daniel and wife, 336 Belmont avenue. This was Mr. Daniel s first trip to Toledo in five years, visiting his brother and friends en route home from the World's fair.
