SATURDAY, OCTOBER 28, 1944 OEMS RELEASE PAMPHLET ON RACE PROGRESS NEW YORK—A picture pamph let illustrating the progress the Ne gro people have made under the liberal administration of President Roosevelt was released this week by the Democi 'tic National Com mittee under the title "The Roose velt Record and the Negro People." In an introduction to the sixteen page picture book. Congressman William L. Dawson, assistant chair man of the Democratic National Committee states: ‘Those who oppose President Roosevelt are the old forces of Hooverism that wrecked the na tion once and brought miserv. un employment and disaster to the common man. Under Hooverism the plight of Negro men and women reached its lowest ebb, •Today victory is in sight. In the days of coming peace, great tasks that require experienced and proven leadership lie ahead We must go forward and continue to build upon the tremendous social and economic gains that have come to us under the administration of President Roosevelt." The picture pamphlet illustrates Negro progress in various fields in cluding the Army. Navy. Air Forces and the Merchant Marine Dis tribution of the pamphlets will be heavily concentrated in the key states where the Negro vote may well decide the election. Truman Blasts Republican Smear Charging that the statements at tributed to him by a "Socialist Party Agent" which were pub lished last week in a few Negro newspapers were a "deliberate fraud on the Negro people," Sena tor Harry S Truman dared anyone to challenge his liberal record in a statement issued Friday. The Democratic vice-presidential candidate emphatically re-stated his position on the Negro issue, declaring. "I am for a permanent FEPC I am for a Federal anti lynching law lam for a Federal law abolishing the poll tax." Branded Statements Senator Truman branded the statements published about him last week as "false" and the pur pose of the smear attack was "to win a few badly needed votes for the hopeless Republican cause " Expressing full confidence in the judgment of the Negro people, the Senator declared "This desperate last minute man euver by the Republicans, so rem iniscent of the scare tactics in other campaigns, will not fool the Negro people "As in 1912. 1936 and 1940. they will vote again for equality of opportunity, full employment, bet ter wages and decent housing as sured them by the liberal Roose velt administration, which has done more for Negroes in twelve year* than all the Republican adminis trations since the Civil War." Tann 1 HOLD NO ILL feeling; says SENATOR DIGGS “Although I waa only one of twenty defendants in the State's alleged conspiracy that the Court took occasion to take advantage of a technical error and order the cancelling of my bond and my sub sequent confinement to Jackson. I hold no malice or ill feeling to ward any one," Sen. Charles C Diggs said In a statement this week The senator, who was released last Wednesday from Jackson Pris on by order of the Supreme Court of Michigan and granted an ex tension of time In which to pre pare hia appeal. Brief Effective Harold E. Bledsoe, attorney for Senator Diggs, told the Chronicle thia week that the brief filed before the Supreme Court was effective in getting the Senator's release be cause there was no answer that could be givan to the charges that Judge Simpson had denied basic rights of hla client in committing him to prison Did Net Fellow Procedure Said Bledsoe. "The trial judge in this case did not follow the cus tomary procedure of granting or denying the application presented by my client, by so doing he di vested himself of Jurisdiction to hear the application for extension of time and seriously prejudiced the rights of the defendant In this case." The brief filed by Attorney Bled soe set forth the following points in the Diggs case: Senator Diggs was charged on or about March 14, 1944. with conspiring to affect and influence action on the legis lature of the State of Michigan. He was tried by a jury and found guil ty aa charged and sentenced to Jackson prison of Southern Michi gan on August 12 for from three ; to five years by the trial judge. The brief continues that the Sen ! ator then availed himself of the statutory period within which the j statute permits him to institute i proceedings with leave of the Su preme Court to have hia case re viewed by that court. Claim Filed Bledsoe charges further In his t brief that on August 30 claim of | appeal of Charles C. Diggs was filed, but inadvertently the claim was irregular and incomplete. On September 1, the brief claims that the calendar entry shows that a claim of appeal of Charles C Diggs was filed This claim was regular in its form and within the twenty day period provided by law. On August 29. the record indi cates that a motion for extension of time in which to perfect appeal, subscribed and sworn to by Charles C. Diggs, which sought the aid of the trial judge to extend time to perfect his appeal. At this time the required fee was paid and de mand was made for testimony. Not Notified Bledsoe charged further in his brief that he did not know of the ruling of the court with reference to errors in the appeal until he saw it In the Detroit Free Press on Sunday. October 1. Called to Lansing on Monday. October 2nd before the trial judge. Diggs' bond waa cancelled and he waa committed to Jackson prison. At the time the Judge acknowl edged receipt of the Senator's claim but declared that it did not mean anything, in as much as he had lost jurisdiction. On the basis of the foregoing brief the State Supreme Court is sued an order for the release of Senator Diggs on October 18. "I am still at a loss to under stand why the trial judge did not notify Senator Diggs or his coun sel of his intention to deny the application for an order for an ! extension of time in which to per- ! feet the Senator s appeal." Bledsoe said. Said Diggs. "I feel that certain interests are behind this incident and they feel my elimination re moves one- obstacle in their own nefarious political schemes." Richard S. McGhee against Mr. and Mr*. Nolan Turner of 13613 Trumbull, grew an agree ment on the part of the Turners to move within 90 days. This agree ment followed a series of court bat tles in which assault and battery charges were filed and dismissed. Prior to this action. Mr and Mrs. Turner had secured an injunction restraining either of the McGhees from going on the premises for “purposes other than business.” This injunction is still awaiting fur ther court action.
