Washington, June 2 The secretary of war lias transmitted to the senate committee of the Philippines a copy of a report made by J. G* Livingstone, governor of the Philippine , province of Lorsogen, of the killing by sol diers of two native officials of the town of I Santa Magdalena of that province One of I the men was the presidente of the town I named named Ysidro Gallanosa and the other a. policeman The secretary of the town, one Quintin bamit, also aa tortured for the I purpose of forcing a confession from him | Governor Livingstone says that a native I who was trusted by the American authori ties was sent to the town to spy out men connected with the movement known as the "anting-anting jno\eruent, that he arrested i some such men and took them, with their I papers before the presidente, and that while ! all were there, a detachment of troops under j a corporal entered and arrested all as in surgents Thev were then taken before Lieutenant F W Harker of the Fifteenth Infantry, who put them to work on the streets The report continues The next day the presidente and Garni were taken out into t i e woods and hung until their fett were nearly ond the ground and were asked of thev would talk, to whicn they replied that they would, naturali iney were returned to Matnog vvheie me secie tary was again questioned b Lieutenant harker as to the conduct of tne presidente, giving according to his (the secietary ) statement satisfactory answer He was later, with the presidente and Uiaracos tuenos, a policeman of Magdalena, again taken to the hills, being compelled to cairy a rope, a pic-h. and a spaue, and on reaching a certain spot the presidente was put to woik digging vvnat would appear to be a grave Then ihe presi dente was bound ana shot in the back i n c secretary says that he _aw all of this himself, and also saw tne policeman bound in tne same way and a little later heard shots which he presumed were Area at the policeman, as, he was also killed , The report also sajs It ls'claimed that the presidente and policeman attempted to scape, and the soldiers concerned have made affidavits to this effect, but I believe this to be absolute!} untrue Governor Livingstone concluded by giving his own opinion of the case, as follows Upon careful consideration of the whole question, and from my knowledge of the con ditions existing at tne time, and from my personal knowledge of those most dnectly concerned, I am iorced to the opinion that the original order for the arrest ot these men was absolutely unwarranted, possibly due to the malinterpretation and overzealousness on the part of tne corporal, that the two prison ers killed did not attempt to escape, and tnat their killing was murder Enclosed with the governor s report are affidavits of the private soldiers who shot the presidente and also an affidavit from a native prisoner saying that the presidents had allowed him to .escape for pav There also is a report upon the case by Captain E Wittenmeyer of the Fifteenth infantrj, as follows.
