Bona Fide Settlers' Claims May Be
Construed as Controversies with

Alleged Error Involves Large Area.

Washington, March 18.Land Com
missioner Richards, with the approval
of Secretary Hitchcock, has sent com
munications to local officers in Min
nesota relative to swamp l|inds, which
have an important bearnig on the ef
forts now being made to secure a
change in the departmental practice
in adjusting state swamp grants.
One letter, in the form of a circu
lar, directs local officers thus.
For the protection of bona, fide settlers
who allege settlement prior to the is
suance of the Minnesota swamp land cir
cular, dated April 4, 1903 (under which the
department is now acting), upon lands re
cently surveyed, direction numbered 1,
page 6, of said circular, may be so con
strued as to olass such cases among the
existing controversies between the state
and bona flde homestead settlers, provided
the settler made a proper homestead ap
plication within ninety days after filing
on plat, accompaniediby a proper swamp
land affidavit
The effect of this letter as to all
innocent bona fide settlers, is to at
tack the field notes of recent surveys
instead of accepting them as conclu
sive proof of the character of the land.
Another case in which action is ex
pected relates to the swamp land in
the Leech Lake reservation, embraced
in lists Nos. 153 and 154, which the
secretary has ordered patented to the
state, but which is held up until fur
ther orders.
Major Scott, the Indian agent at
Leech Lake, has protested against this
action, alleging the land is not swamp,
but high and dry pine land. Secretary
Hitchcock has instructed the commis
sioner to direct an exhaustive exam
ination of the surveys involved "with
special reference to the swampy or
nonswampy character of lands. In his
letter to the commissioner the secre
tary says.
There is nothing in the rule of practice
now in force whieh inhibits the field ex
amination herewith directed or which de
nies the consequences that may result
from such examination
The field notes of the survey adverted
to in the rule are not such as may have
resulted from gross error or fraud, but
field notes of a fairly accurate and honest
survey, and the government is under no
sort of obligation, either by reason of rule
or otherwise to patent lands to the state
upuon returns of fraudulent surveys
Of course, it is not the intention of the
land department to give an ear to every
allegation of error and fraud in surveys,
but where, as in this instance, it appears
that a large area of country* is involved
an investigation should be made

Butte, Mont., March 18.The long
standing trouble between the bar
tenders' union and the American la
bor union came to a head to-day and
almost caused several small riots. The
majority of bartenders are affiliated
with the international union and re
fuse to affiliate with the local Trades
and Labor assembly The latter tried
to force them into line, but so far
without result The threat of the as
sembly that they would place the
saloons, where the international bar
tenders were employed, on the unfair
list was carried but to-day and boys
were stationed in front of several
establishments carrying banners on
which was inscribed "Notice to or
ganized laborthis saloon is unfair,"
and signed by local unions affiliated
with the A. L. U.
As soon as the bartenders heard of
this a delegation was sent out and the
membeis secured every banner in
sight, taking them by force from their
holders
The Trades and Labor assembly de
clares that the fight is on to a finish,
and that the banners will be replaced.
A fight is expected.

Lincoln, Neb., March 18.Bishop
Bonacum of the Roman Catholic see
of Lincoln was defeated in a long
pending controversy with Fath er Wil
liam Murphy, one of the priests of his
diocese, by an opinion made last night
by the Nebraska supreme court.
The court affirms in, every particu
lar the decision of the district qourt
of Seward county and enjoins the
bishop from disturbing Father Mur
phy in the possession of the church
property at the town of Seward.
Bishop Bonacum's appeal is dis
missed.
Many months ago Bishop Bonacum
removed Fath er Murphy as pastor at
Seward and .later excommunicated
him, but Fath er Murphy, with the aid
of the trustees, who were on his side,
retained possession of the church
property and continued to hold ser
