Gourdain, V, who was released from the Cook county jail yesterday on bonds of $10,000, pre sented, a shoit time later, the unique spectacle of a man trying to break into v., the penitentiary. After he was given his liberty the former banker hurried to Joliet and demanded that he be incarcerated im mediately. The deputy gently but firmly denied the strange request and Goiudain started back to Chicago with the avowed intention of instituting mandamus proceedings to compel the authorities to put him in prison at once so that he might begin serving the four-and-one-half-year sentence for op erating a lotteiy. Failing in court measures, the dis gusted man says he may be driven to build a penitentiary after the same ar chitecture as the prison at Joliet, be his own jailer and warden, and serve the time 'named by Judge Landis. I am in earnest," said Gourdain, "in saying that if I cannot serve my sentence any other way 1 shall build a penitentiary somewhere and live in a cell for four and one-half y^ars."
