Journal Special Service. New York, Dec. 7.Justices Gilder sleeve, Amend and MacLean of the su preme court have been called upon to settle a legal problem that is unique in supreme court history. The question involved the reasonable expenses of a wake. The justices heard argument on the appeal of Joseph J. McCullough from an adverse decision to recover $71.25 from CharlesMcCready and Rich ard S. Treacy, executors under the will of Peter McCullough, covering the ex penses of the wake. Mr. Clare in his argument first sought Webster in defining a wake and then quoted at length from the Bible, the Jewish encyclopedia and even from Shakspere and Virgil, to show how in all ages it has been the custom of man to make merry the presence of death.
