. 'BUTTE, Mont., Feb. S. Findings of

noted case of Hugh Magono against the
different smcltlnjr and mining: companies
of Butte and Anaconda have been re
turned, finding: practically for the defend
ant companies, on the grounds that tho
damages accrued from the pollution of
the streams Into which tho tailings from
tho smelting and mining plants had been
dumped, In turn being dejositcd on farm
ing land In the Deer Lodge valley, waa
more than offset by the general good rc
bultlng from the operation of the smeller,'
which the action of Mugouc sought to
close.
Will Be Submitted.
Master Crano'a findings will bo nub
initted to Federal Judge William II. Hunt,
who In turn will pass upon the Master's
decisions, deciding whether or not an In
Junction order against the smelling coin
panics Khali be Issued.
Would depopulate Camps.
Magono represented a largo number of
ranchers In the Deer Lodge valley, which
section of tho country Is Irrigated by the
Deer Lodge river, which river Is fed by
polluted creeks from Butte and Anaconda.

with concentrating, says Master Crane,
and mnke the mines of Butto pay, and
In turn the stren.ms arc vital In the
process of concentration, affording the
necessary water with which to concen
trate the ores: Hence to compell the clos
ing of the concentrators and smelters will
mean tho shut-down of tho Butte mines
and the cons-pnu,,nt practical depopulation
of Butte and Anaconda.
Companies Attempt Improvements.
Figures are also submitted showing the.
millions of dollars Invested by the differ
ent companies In smelting Improvements
with a view to rendering tho water of
the streams as pure as possible. The time
consumed In hearing the Magone ca6e
breaks all records In this State, "more than
nine months being consumed in the taking
of testimony, expert and otherwise. The
transcript embraces about 7.000,000 words.
I STRIKE IN LEMHI.
Rich Discovery- Made on the Lendvillo
-. Mine at Junction.
Interesting ncwr comes from the mines
of Lemhi county (Idaho) district. In which
a number of Salt Lake Investors have
considerable interests. Strikes of great
Importance have been taking place for
some time past, and the district Is giving
every promlso of being listed with thfc
most Important producer-, of that Stat,
and perhaps the West, within a verv
short time. The following article from tin
Lemhi Herald will b: of Interest to the
mining fraternity of this State:
"The tMephons to Junction Saturdav
cning revealed the glad account of a
rich strike of ore In tho Ladvlllo mine,
belonging lo the Junction Mines ccmpanv.
For the past six weeks this company hns
had forces of men employed on contract.
, .di.Jtlng upon two separate levels. The
tipper level has been continuously in ore
and during a part of the time they havo
had ore In the lower level, but on Satur
day tho lower, or ICO-foot level, broko Into
a body of steel galena, making solid ore
of the entire face.
"The exact dimensions of the body have
not yet been ascertained, but enough ap
pears to say that it Is seven feet wide. It
Is the same shoot that has been exploited
on the surface, nnd found to bo several
hundred feet long, and Its appearance
thus, lfiO feet below the apex. Is In tho
exact position where they expected to
find It, Tho o, to all appearances. Is as
rich as any the mine has ever shown. Ali
the assays made have shown 10 to 5S per
cent lead and S2 to -15 ounces of silver.
"The distance to tho railroad at Rd
rcck. or the lieu station of Armstead, on
the Short Line, Is forty-ono miles, and a
good wagon rnnd traverses the distance.
This gives the company a splendid chance
to get action on the product at once, and
It Is sure that the coming summer will
see great shipments of ore going to mar
ket. It is regarded as one of the best oro
discoveries ever made In that countrv.

engineer and operator, has returned from
an Inspection trip into the Indian Terri
tory. He examined a lead proposition for
Eastern people In the Territory, on which
his report was favorable, resulting In tho
closing of a deal for the property. Whllo
tho district Is practically a new one,

Ore and Bullion.
The oro and bullion receipts for Thurs
day, given by McCornlck's bank, were as
follows: Ore, f51,200, bullion, $71,400; gold

People the world over were horrified

Stock of Company Climbs Rap
idly Toward the Mark
of Fifty.
According to the Boston Commercial,
Bingham Consolidated was one of the most
conspicuous features of the past week of
the copper share markot, being character
ized by an unusual degree of activity and
strength. Predictions are freely made In
Boston that tho stock will cross 50 In tho
near future, and this prediction, made sev
eral days ago, was very nearly made good
on Wednesday last, when tho highest
point reached by tho stock in Boston was
149.73. It Is regarded In this city as cer
tain that tho stock will pass the CO mark
beforo the expiration of the present week.
It Is a matter of surprise that the stock
has not far exceeded thin point already,
and It would havo dono so had the mar
ket bcon based purely upon earning ca
pacity and not upon speculative founda
tions. Control Changes Hands.
That earning capacity, howovev, still has
little to do with the price of stocks Is
Illustrated by the following excerpt from
the Commercial: "Chiefly responsible for
the attontlon which contered on the stock
was tho announcement that tho control of
the Bingham company has already
changed hands, the deal being effected by
the transfer of a big block of stock, un
derstood to be about 50,000 shares, at be
tween $35 and $t0 per share. The buying
thut has been In evidence during the past
fortnight has been the passing of the
shares held by local people to tho new In
tercuts. New Owners Unknown.
"What Is puzzling the street Is the iden
tity of theso new owners, rumor having
It, first, that they are allied with the
American Smelting and Refining company
and then with tho United Slates Smelting
company. Whatever the truth may be, It
Is said that there will be no change In
the management at present, and that the
present lines of operation will be adhered
to for the time being."

ments of such properties as the Shoshone.
Original Bullfrog, Denver Tramp, Gold
Bar. Eclipse. Gibraltar and other mines
will contribute their share towards the
erection and equipment of thlc plant. It
is thought that the plant will be con
structed fo as to constitute the first unit
of a much largor mill, should tho develop
ments warrant It beginning, perhaps,
with ten Btamps and with all tho acces
sories Incident to such ontorprlsee. Thore
Is llttlo question In the minds of those In
terested but what the mill will prove to
bo a financial success, In addition to
teaohlng lessons tho Importance of which
can not be overestimated.

ores found In tho Bullfrog district do not
anticipate ans- great trouble In solving the
treatment problems, as it Is thought cer
tain that tho ores will be found suscept

Mining Statistician Declares
Bnttc Is Producing More
Ore Than Ever.
John Kdgerton, who Is identified with
tho statistical work of the United States
awsay olllce at Helena, Mont., Is regis
tered at tho Knutsford hotel His mission
to Salt JLake at this tlmo was to meet "SV.
M. Belcher of Boston, who Is heavily In
terested In a number of Montana proper
ties, and who arrived hero Thursday, on
his way home from a trip lo tho Pacific
coast.
Output of Butte.
Mr Kdgcrton stated that the mining
conditions at Dutte and throughout tho
Stato of Montana are excellent, and that
Butto hill Is producing more copper at
present than ever bt-foro in the history uf
the camp, there being now emplos'ed In
the nilneb approximately WC0 men The
output of Butte minea for last year. Mr.
Edgcrton states, was 70,0) ounces of gold,
12.&00.000 ounces of Bllver and 310.Oj0.0C0
pounds of copper, which shows an In
crease of about SCOCO.OOO over the year
1004.
Experiment With Gold Oro.
The main feature of the mining world
In Montana, during tho last year, Mr. Ed
gerton states, has been the experiments
upon the treating of low-grade gold ore
by cvanlde tests. It hns been shown thnt
ore running J3 nnd J3.E0 can be worked at
a profit. The cost of troat'ng ore by cya
nide tests varies from $1 10 $1.60 a Ion
New Dam Being Built.
The work of building a new dam across
the Missouri river, to replace the old
dam, which Is about twelve miles from
Helena, according to Mr. Edgerton. ha
been commenced and will bf completed bs'
next fall. St-el Is being used In the con
struction of tho tifw dam, and It Is under
stood that It Is being built by the Amer
ican Smelting an Refining company. The.
Cower generated by use of the dam will
0 transformed Into electricity for use in
the Helena plant of the American Smelt
ing and Refining company, and will be
carried to Butte. Basin and other towns
In the vicinity for lighting and motive
power purposes.
MEXICO CON. DIVIDENDS.
Plan of Payments Agreed on by Di
rectors of Company.
It Is planned to begin dividends on the
C50.0CO Pharos of stock of the Mexico Con
solidated company In March at the rate
of 15 cents per share per month The mill
1b now treating between sevenOy-nve and
elghty-thro tons of ore per day, and the
company Is earning JaOSO net In gold per
month above prospective dividend require
ments of 15 cents per share.
The company has recently placed an
order with the Auto Car Equipment com
pany of Buffalo for five live-ton motor
care, which will be used In transporting
Its shipping ore from tho mines to a con
nection with the railroad, sixty miles dis
tant. The Mexican Government has agreed
to build a road which will permit the op
eration of motor cars.
It Is. claimed by Mexico Consolidated
Interests that without doing any more
work, there Is $5,000,000 net gold value of
ore In the mines, or sufficient to pay
$20 per share upon the stock. The lowest
worKlngs of the mines are but 250 feet
In depth and the management has Just
begun sloping. All Its oro shipped up to
the present tlmo hns come entirely from

UTAH MINE DIVIDEND.
Company Declares Thousand-Dollar
Dividend for February.
Tho Utah mine, located at Fish Springs,
again comes to the front and announces
Its $1000 dividend, which the Investing
public has begun lo look upon as a mat
ter of right. At the regular monthly
meeting held In this city Thursday after
noon the directors declared the profli
dlstrlbutlon to this amount, the dividend
being payable the 15th of the month, tho
books closing on tho 13th.
Without regard to tho condition of the
roads over which the company must
haul the ore from the mine to Oasis in
order to reach the railroad, the manage
ment hao been for somo time past stead
ily Increasing tho number of ore teams,
and the working force of the mlno. while
not Increased materlallj has found tho
developments of this property such that
a greater tonnage and of better oro can

Ohio Tonopah will long be numbered with
the remunerative producers of Tonopah.

possibilities of that country; a short time
ago the stock could have been purchased
for a few cents; It was quoted Thursday
at 42 cents.
