Th? evidence for the defepce closed here, and Mr. Radcliffe presented a prayer for instructions to the jury, as follows : 1st If the jury believe from the evidence that there Is a reasonable doubt as to any fact neces sary to constitute the prisoner's guilt under thla instruction, then they ought to acquit him. -2d. If the jurv believe from the evident* that the prisoner intiictrd a wound on the deceased, and that the said wonnd produced death, but en tertain a reasonable doubt as to eh* intention to ?akc life, then they should tind him guilty of manslaughter only. 3d If the jury believe from the evidence that ? he piisoner and tbe deceased were engaged in a rencounter or scuffle, and that during the same ? he wound charged In the indictment was in flicted. under heat of blood and without malice, then tney ought to find said prisoner guilty of manslaughter only. ith. If the jury believe from tbe evidence that the prisoner inflicted the wound on the deceased charged as iu the indictment, but entertain a reasonable doubt as to whether said wound pro duced death, then they ought to acquit. The Court, with some explanations as to the interpretation of the above instructions, granted them * Mr. Maury here made the following prayer for instructions, which tbe Court granted : If the jury believe, from the evidence foresaid, tbat tbe prisoner sUrted in pursuit of the de ceased with the Intent to kill tbe deceased or commit some grievous bodily harm, then the priM>uer in guilty of murder, notwithstanding the prisouer may have committed the act under provocation. Mr. Maury then proceeded to address the Jury at some length, and with much ability; and oh concluding he was followed for the defence by .Mr. Bradley, jr., who entered into a searching investigation of the facts in evidence, and dwefi at some length upon the circumstances surround ing the whole matter. lie closed after speakin about one hour, and the Court here ordered liuhts to he brought. Tbe arguments of the defence were closed bv Mr. Ratcliff-, who piead earnestly in bebalf of the accused for a space of almost two hours On closing, he rented his case upon the point in tbe evidence of Dr. Butt, as to the wound which was inflicted producing death It will be recollect-d that the witness stated his opiniou to be that the wound produced the d-ath of Brown, but that hiving had no post mortem examination of the deceased, there was a certain degree of uncer tainty as to whether the deceased may not have bad some inward disease which being developed bv tbe said wound produced tbe fatal result. Mr. Katclitfe dwelt upon this point at some length, and quoted many cases in medical expe rience in illustration of tbe byjiotbesis He closed by an appeal to the jury in l?ehaJf of the youth of the p'isoner, his young wife and aged mother dependent upon his labois for support in her old age. Mr. Mauray closed in a brief speech, in which he summed up the case, after which it was "iven to the jury. The jury returned very shortly with s verdict of manslaughter. The Court then adjourned. A* Isntas ,k Tale."?The Indian tribes, the Pawnees and Sioux, have long been on unfriendly '*rmi, and some most sanguinary engagements have taken place between them. Delegations from each of these tribes are now In Washington on business with Government, and they have been adverse to meeting amicably, though several attempts have been made to that end ^ esterdav, bowev?r, the Sioux went to the quar ters of the Pawnees, and they met for a friendly ta:k. I also hand yon, with this, an estimate of the receipts and expenditures for the vear 1W. showing that on the 31st of December, )M6, if all general taxes are paid over, together with the interest on the 833.(00 Chesapeake and Ohio Canal Bonds? which until latterly has been regularly paid?the receipts of tbe year will exceed the expenditures by an amount of P9.73U.16; but admitting, which in all probability will be tbe case, that the same amount of canal taxes due in 185* remains over and uncollected until 1839 as is now due and will remain over, until 1858,* is 88.763 39, still the re ceipts of 1?G8, according to this estimate, will ex ceed the expenditures by about ?030, after allow ing 85,000 for contingent expenses.
