The commissaries of musers will be responsible to the adiutant general of the army for the correctness of the musters and musts r rolls in their corps, and no officer sh ill bj musteied in, or out, except by a commis sary or assistant commissary of musters to whom the command to which he btlon^s has b<en assigned. 114. No officer or enlisted man of volunteers is properly in the service of the United States, or authorized <o receive pay, until mastered in by tie proper officer^and no efficer is properly out of service until discharged in Orders, or mustered out by the proper officer. One copy oi the rolls or order in each ca^e must be for warded to the Adjutant General's Office. 1>5. Commissaries and Assistant Commis saries of Musters, having been once detailed, will not be relieved irom this duty, or trans ferred to another Division, Department, or Corps, without authority from the Adjutant General's Office. 1*20. The commissioned officers of all volun teer organizations, no matter whether estab lished under the authority of a State or of the United States, will be r? garded as having been Ci mmissicned on the <?av when their muster into the service of the United States tafces effect, and will take rank in their respective giades, will be entitled to pay and be obeyed and respected in their several positions from that date. 121 Mustering officers will mnster into ser vice and administer the oath of allegiance to such regiments or recruits brought to them as may present conclnsive evidence of their ac ceptance by the War Department. The following explanation to section 5, par agraph 117, Mustering Regulations, (section 5, paragraph 9, General Orders 48, of 18>%) is ani.ounced for the information and guidance of all concerned: When an enlisted man or officer receives a commission or appointment advancing him to a higher grade, and has not an opportunity of being mustered in so as to appear on the next muster rolls as of the grade to which he is commissioned or appointed, he shall be mus tered on the next muster rolls in his proper grade, according to previous muster-in, and a remark to the following effect made on the muster roll opposite his name: Received com mission (or appointment) from the Governor of the State of , as t? the Regiment of ?? Volunteers, on the day of ; waiting muster in since that date. The last sentence of section 5, paragiaph 117, Mustering Regulatlors, edition of August 31, Ij-453, commencing "If on the muster," Ac., shall not be so coustrued as to prevent the mnster- in, by the Mustering Officer, of officers so mustered back to the actual date of receipt of commission or appointment, if it be not more than two montus beyond the mnster at which they appear, as above, on the rolls. # Exception in cases of necessity will be made upon application to the Adjutant Gen eral, Washineton, D.
