They expected to show al this, and, further, that the derendant knew it. I Mr. Mackey said that it must be shown that thesi practices were connived at before they were rele . vant to the Issue. It was necessary to show mon than knowledge?connivance. He denied that an' ; language attributed to Karcher could be construe! Into connivance, and said It was the language a rage. He denied that this testlmonv was admissl ; ble, for the defense was self-defense, and he fur ; ther claimed that it must be shown that there wa more than knowledge or connivance?that ther ' was consent. Witness once heard (about three months ago) a controversy between the hus band and wife as to her conduct She had called on him to arrest him, but he declined. He ther called her "a ," &c., and she replied that he was a liar. To Mr. Mackey, on cross-examination, witness said he did not Know personally or any lewd con duct on her part, nor did he Inform Karcher of anj such conduct.
