New York, June 27.?Jacob Sharp tottered Into court this morning looking worried and worn, with hardly a vestige of color In his wrinkled and woebegone face. The reason for this was that he had passed a terrible night, not even getting as much sleep as was his lot Saturday night. Mrs. Sharp, who had been allowsd to remain with hlui, bad been assiduous in her attentions, and had not rested one moment during tbe entire night. With tbe beginning of the reading by Mr. Nlcoll of his testimony beiore the senate investigating commit tee he opened bis lustreless eyes and attempted to interest himself in the proceedings. Tbe first business ol the session was to adjourn the June Oyer and Terminer to Monday, Juiy lltb, after which llarrlson D. Kerr, one of tue seventh Avenue directors, was called as a witness for the prosecution, but he falling to respond. Senate stenographer Correll was recalled while tbe bal ance of tbe testimony ot Sharp berore tbe seuate committee or so much thereof as tbe prosecution desired was read by tbe assistant district attorney. Mr. Nlcoll finished reading the testimony at 11:17 and rested the case for the people. Ex-Alderman Fullgraff came into court and had a short private conference with Peter Mitchell, of counsel lor tbe defense, then hurried out, closely followed by the district attorney, who acted as though he was fearful that the State's best wit ness was going to turn traitor and be must do something to prevent it. A ten-minutes rest was taken after the prosecution closed, after which Mr. Parsons arose and commenced the opening ad dress in behalf of tbe defense. Mr. Parsons said that the duty had fallen upon him to open for tbe defense, but beiore be pro ceeded to do so he had two motions to make that he desired to have appear on the records. First, to ask the prosecution to elect whether It would stand upon that part of tbe indictment charging an agreement to bribe Fullgraff, or upon that part alleging that he was in fact bribed by Sharp. Motion denied. a motion to Acqrrr denied. The second motion was that the court advise the jury to acquit tbe defendant us tbe case now stands under section 410 of the code of criminal procedure. This motion was also denied and an exception taken. Mr. Parsons then opened as follows: "If there has been any expectation that counsel for the defense supposed that this case was to be won by tbe use oi eiegant rhetoric, by eloquent appeal to tbe sympathy of the jurors, that expectation will be hardly realized by anything that I shall have to say. My duty Is simply to state the defendant's ease and review the testimony before you. I ask your lorbearance, gentlemen. Some of you have been here a long tune, or, at least, since May 10. 1 ask your forbearance now, because the defense, for theilrst time, has a right to be heard. It is a great einbarrassmeut of a defense in every case that tbe prosecution has the right to put its case and make Impressions that may find a lodgment in jurors'minds that are difficult to remove, i may as well say here what I shall have to say here after, that this large mass of evidence which has been Introduced by the prosecution has made no case." In the criminal Court, Jiulge Montgomery , this morning, Edward llall, a young white man, w as placed ou trial on the charge or assault and bat tery with Intent to kill John Thornton, colored, on the 18th of April last, by shooting him In the chin. The testimony showed that Thornton w ent to Hall's restaurant ami, being Intoxicated, Hall suggested that he drink something soft instead of whisky, and, some words passing, It is alleged. Hall put him out and then shot him, the ball en tering his chin. An incident of the trial w as tak ing the testimony of Charles Lammon, a d -af and dumb colored man, who, alter signing the oatu, made out his statement. Ob the part of the defense it was testified that Thornton was drunk and disagreeable and w as several times put out of the saloon, but came back vowing to get even with those who put him out, and he came back threatening to cut Hull'i heart out, and when he broke the glass out Hal shot to stop him.
