Mr. Lamar's vote is not far from that of Stanley
Mitthews. who*- case w.is a relic 0( the quarrels

historically speaking. as upon the confirmation or
rejectl?m of his nomination hung practically tbe
<|ecM> >u of the question whether men who had
taken part In the sec-sslon movement should be

into the executive branch of the Gov
ernment and Into the legislative branch; but
the app- intinent of Senator Jackson to be circuit
judge of the sixth Judl lal circuit was the first
noteworthy case of their return to the Judicial
branch. Mr. Jackson never took a prominent part
In the rebellion, but was a sympathizer with It,
and accepted an Inconspicuous ctvd office under
the confederacy. As he was a member of the sen
ate altnos; up to the hour of his nomination, and
personally a favorite wlib his associates, and as
his course since the war had been extremely con
servative, there was no organized opposition to
him. and his case could hardly be regarded as a
precedent, Mr. Lamar, however, by his defense of
Jefferson Davis on the floor of the Senate, and his
many approving references to the position of the
southern Mates in the civil contest, had made
himself a shining mark for the shafts of his oppo
nents; and the fact that his was the first case of
:ae nomination of a participant !n secession to the
<-ourt of last appeal, whose members are called
upon to settle the gravest questions of constitu
tional law, caused many senators to put their dis
approval on record, as it were, even though lew
probably bad any Idea of procuring his defeat.
A correspondent complained the other day
against the "screeds" published In Tnr. St*k
about high house rents in Washington, on the
gTound that sucti articles "do Injury to the city."
on similar grounds, doubtless, complaint could be
made of the occasional mention that the streets
are not swept as often or as thoroughly as they
ought to be. or the suggestion that the popular
demand for a better water supply should be met
by hastening work on the new aqueduct. The
only way certain defects In the city's gov rnraent,
its public works, or its social custom* can be
remedied is by drawiog attention to them. And
In this line It is a proper sublect of ulscusalon why
It Is that, with as mu -h unimproved land as we
have now within the boundaries of Washington,
t h^re are so few houses for rent at a low figure,
easy of access to departments where clerks are
employed by the thousand at salaries ranging
from twelve to e'Khte-n hundred dollars. These)

of tenants. They are apt to be methodical !

The report of the New York slate commission to
tn-wbrad the best method of executing the i

which was briefly sketched in these columns a |
we?'k or two ago, in a review oi the correspondence '
which hu l poured in upon the commission since
their invest! at tons began. It sets forth the great I
advantjge^ of e.e, tncity over any other method
su?-ge?;ed. as being bloodless. Instantaneous, 1
and never-failing In Its operation, and apparently
painless. The particular form of application pro- i
pose i by the '-on,mission is the familiar one of the
chair, with foot real and headrest, to which the'
eontlet u fasten-d, aud tn which he Is suddenly
stricken dead by the pressing of a button.
It would he possible, of course, to make this
more strictly automatic than any other mode.
The button might be connected with a clockwork
apparatus so arranged that the pressure would
occur at a certain nertnent, perhaps not dellultelv

function would be tbe windlug up of the main
spring when he received word from the sheriff that
all was ready. The absence of direct human agen
cy In the matter would rob the opponents of the
system of their standard objection, that any

is little douot that if the experiment of electrical
executions were once fairly made, the rope would
go out of vogue ever; where except In frontier set
tlements.
Cincinnati yesterday witnessed the extraordi
nary spectacle of an entire court of the Vnlted
Mates?Judge, jury, crier, clerks, tipstaffs, coun
sel, prisoner, and all?taking up its march In
solemn procession to the house of a private citizen
lor the purpoue of hearing hLs testimony as he lay
stretched on a couch with a broken leg. This sort
of thing re- alia the origin of the term "circuit,"
now so cotLinonly applied, without a definite
meaning, to courts which are really local, but
g-ilng back to the practice of the Judges when they
carried their tribunals around with them from
place to place, and sometimes forced an obstfbatc
jury to a conclusion by bundling them Into a
.prtngless cart and driving them over the roughest
road in the district.
All this formality at Cincinnati was due to the
dealrefora full examination of the wounded wlt
i,esa, including answers to cram-questlona, which
could bet be obtained by a mere written depusi
tl -n. It was in the lliter.*' of falrnesa to the de
feadaf, one of the chief officers of the late Fidel
ity bank, and shows how careful a regard Is
always bad for the rights of the Individual as
against the state, even in a court constituted by
the state fir the purpose of bringing to punish
ment offenders against its peace and dignity.
We who live in a mild and cheerful climate have
