THE ISSUE DISCUSSED REPLY TO MR. MRA1 AND HIS Application of the Proposed Law on Interstate Commerce-The Di ferences Noted. Dr. -W. C. Wodward. the health officer, has submitted a statement to the Com missioners in reply to the letter of Mr. 4 William Frear, - chairman -of the executive committee of the Pure Food Congress, and others, dated January 5, 190, 'lative to certain "pure food legislation" now pend in't in Congress, and to the recent commu nication of his ofi~cp concerning the same. "The health department has approved none of the so-called pure-food legislation which Congress has recently been so strongly urged to enact." said Dr. Wood ward. "It has, however, not felt called' upon to oppose such legislation so long as the interests of the District were not in volved. The letter recently addressed if the health officer to the Commissioners relative to such legislation explicitly rec ommended 'that the Commissioners, with out committing themselves generally either for or against any of the pending legisla tion for the regulation of traffic in foods and drugs, take such action as may be necessary to secure the exemption of the District of Columbia from the operation of such legislation as may be enacted.' "Whether the pending pure food legisla tion will, if enacted, repeal all or merely a part of the laws now in force in this Dis trict relative to such matters is not yet -apparent, even after a most painstaking examination of such legislation and in view of the fact that the writers of the communication now under consideration have failed to atate any reason for their opinion that it will not repeal such legis lation except in so far as relates to inter state commerce, the health department must decline to accept such opinion. Would Hesitate Even Then. "If the enactment of the pending legisla- 4 tion were likely to result In such incalcul able benefit to eighty million people, as suggested by Mr. Frear and his associates, and it were impossible to amend it so as to duly protect the interests of the three 4 hundred thousand citizens of this District, the health department would hesitate long before taking any action that might hin der or prevent its enactment. The depart ment has, however never been able to dis cover the enormous benefits to be derived 4 from the enactment of this legislation and Is quite confident that, in any case, the proposed proviso exempting the District 4 from its operations will in no way impede its general efficiency. In view of the fact that by the communication submitted by 4 the gentlemen above mentioned the general merits of such legislation have been drawn into controversy, and it is sought to sac rifice what the health department believes to be the interests of the people of this District, If necessary, to secure the enact ment of this measure, the views of the 4 health department relative to its general value may well be considered. "The object of the legislation now under consideration is to insure purity In foods and drugs sold throughout the United States, combined with uniformity of trade e conditions,.as to standards, etc. This ob ject is admittedly meritorious. The merits of the legislation itself, however, must be determined by the manner in which this object is sought and the extent to which it will be attaindd, and cannot be predicated on the meritorious object for which such legislation is designed. t Each State's Exclusive Turisdiction. V "Each state has exclusive jurisdiction over o commerce In foods and drugg within its f borders. The proposed legislation cannot n reconcile differences between state laws a 0: and, therefore, its enactment will not ma terially relieve dealers from the necessity s for complying with the requirements of each state within which they do business. "The enactment of the pending legislation will merely establish in each state stand- ir ards for interstate commerce distinct from standards for commerce wholly within the q state, and which may or may not be iden- t tical with such standards. This in fact is t the extent of the power of the federal gov- p ernment so far as relates to the sale of h foods and drugs in the state. "If the interstate standard for any article r is more rigid that the state's requirements. the dealer within a state cannot lawfully t purchase such articles in another jurisdic- t tion, except it be of a higher grade thans the state requires, however advantageous it might be for him to do so. Nor can a person or corporation in another jurisdic- r tion lawfully sell it to him unless it be of such higher grade. ' "The proposed federal law, if enacted, willt be a channel through which state laws mayn be evaded. "The sale of a substance, although forbid den by state laws, may, if the proposed legislation be enacted, be made under the i very protection of the 'federal government, a provided only that the substance be packed b and shipped from another jurisdiction so as h to be sold by the consignee in original, un broken packages; although if produced in t~ the state it may not lawfully be sold under e any condition. A producer doing business tE within the state will be thus subjected to t) unfair competition under the protection of the federal law. State Laws Sole Protection. State laws will continue to be the sole o protection of consumers ao far as relates to the sale of adulterated foods and drugs. a Evasion of the purpose of the proposed legislation will be so easy that the law it- I self will be eierely a tax upon the ingenuity a of dealers in determining methods of ship ment. It will afford no protection to deal ers beyond that afforded by state laws. The original package may be labeled in conformity with the federal law and inC keeping with the nature of its contents while the packages within, intended for local trade, remain unlabeled; the labels, either forwarded separately by the mnanu facturer or prepared within the state, be- 3 lng affied when the original package is t opened. Or the goods, labeled in conformi-. 3 ty with federal law, may be shipped in bulk, while containers for retail trade, Ia- C beled in an entirely diflerent manner, are 0 shipped separately or prepared within the a state and filed from the original package within the state. Or the artice may be ? shipped into the state in conformity with federal law and the adulterant shipped int the same manner or prepared with~in the 3 state, mixture being subsequently effected C within the state. The enaotment of the proposed federal law will not reduce trade to a fairer basis than at present. The honest dealer may have to resort to subterfuges mentioned in the preceding paragraph whenever state standards are less severe than federal re quirements. A dishonest dealer can resort to them whenever he desires to do so sab ject merely to state laws. - The general enforcement of' the proposed law will necessItate enormous expendituires by the federal government with no corre.. sponding benedit. - f Interstanse traffi in' foods and drug, per meates every part 'of the United Staten - reached by mail and by express..
