June 8.?While in pursuit of three burglars jesterday Peter Zabrlskie, a resident of this place, and Policeman Herman Jewett were shot and badIv wounded. The burglars escaped. They had visited the home of John A. Zabriskie only a short time before, but were frightened away by" the barking of a dog. Mr. Zabriskie notified his brother Peter, who lives in the next house, and the two pien started In separate automobiles to search for the burglars. Policeman Jewett accompanied Peter Zabriskie. Zabriskie and Jewett found three Italians waiting on the platform of the railroad sta tion aT Fairlawn. and demanded To know what the Italians were doing. Va., June R.-Thc Jury In the case of Warwick Uatllff, charged with assault on Miss Ona Bird while she was eloping with Arnold Gladwell, at noon yesterday rendered a verdict of guilty, with a recommendation for mercy. Judge Bennett sentenced Ratllff to twenty years' imprisonment, the maximum penalty under the verdict. An incident of the trial was the refusal of Judge Bennett to grant Warwick Bailiff's motion for a change of venue. The prisoner's counsel noted exceptions to the court's rulings, and gave notice that the case would be reviewed by the court of appeals In the event of conviction. Fifty talesmen were examined before a jury was selected to trv the defendant. Thlrtv five or more talesmen frankly ronfessed they had heard of the rase and formed the opinion that RatllfT Is guilty and should be summarily dealt with. Many citizens were examined by Counsel Ozenton in support of his motion for a change of venue. All of them declared public sentiment was so strong against Ratllff that in their opinion he could not get a fair and impartial trial. Prosecutor Hill adduced testimony front a dozen or more residents who swore that there was no more feeling against Rat lift here than there would be anywhere else. rhey declared emphatically that Bcntimcnt was against the crime and not the person charged with committing It. Condemned Lynching. Judge Bennett Is believed to have realized the danger of violence in case a change of venue was granted. He condemned lynching and threatened to deal severely with any one brought before him for making threats against either Uiitllff or his alleged accomplice, Albert Gay. "Mr. Sheriff," said the judge, "I want you to keep your eyes and t ars open for these smart would-be lynchers and bring every one of them into court. Pocahontas county has got some very good people in it, but is also well supplied with fools.
