C Charles W. Morse, New York shipbuilder; his three sons' and others' ad charged with conspiracy to defraud Ca the United States by means of war contracts with the Shipping Board, today filed an application to the Dis- n< trict Court of Appeals for the allow- ce ance of a special appeal from the de- ta cision of Chief Justice McCoy in Criminal Division 1, overruling demurrers te filed to the indictments. Application ot for a special appeal is necessary be- ar cause the order is' interlocutory and si? not appealable as matter of right. w Through Attorneys Wilton J. Lam- bt bert, R. H. Yeatman and W. Bissell th Thomas the accused claim they should ^ not be put to the expense of a trial ? under an indictment which they believe to be invalid because it charges the formation of a conspiracy to defraud through contracts when no such contracts were in existence. The conspiracy, they assert, is alleged to deal = with the manner in which these con- ! tracts should be performed months be- ! fore such contracts were made. The appellate court is asked to settle the | law points in advance of a trial. United States Attorney Gordon and Assistant Attorney' General Dobyns have ten days in which to file opposition to Hie request for a special appeal.
